Jordan B. Schwartz is a Labor & Employment Partner in Conn Maciel Carey LLP’s Washington, DC, office.

Jordan counsels employers on a wide range of complex employment-related issues and defends companies against claims of discrimination and harassment, misappropriation of trade secrets, and wage and hour violations. He advises property owners, operators, and businesses on compliance with Title III of the Americans with Disabilities Act and defends accessibility claims involving architectural barriers, customer-facing policies and procedures, and digital accessibility. Jordan also works with hospitality companies, clubs, retailers, and other public accommodations to assess accessibility risks, develop compliance strategies, and respond to litigation, investigations, and demand letters.

Key Services

Americans with Disabilities Act (ADA) Litigation and Accessibility Compliance

  • Represents property owners, operators, and businesses in ADA Title III litigation nationwide.
  • Defends claims involving alleged architectural barriers, inaccessible websites, and accessibility-related policies and practices.
  • Counsels hotels, restaurants, clubs, and retailers on website and mobile application accessibility and compliance with WCAG standards.
  • Advises hospitality, club, retail, and commercial property clients on proactive ADA compliance obligations and strategies to reduce litigation risk.
  • Conducts accessibility assessments, ongoing compliance initiatives and remediation plans.

Wage & Hour Compliance and Litigation

  • Defends employers in single-plaintiff, collective, and class actions arising under the FLSA and state wage and hour laws.
  • Advises employers on wage and hour compliance, including employee classification, compensation practices, and timekeeping requirements.
  • Conducts proactive wage and hour audits and develops strategies to mitigate litigation risk.
  • Counsels employers on overtime, minimum wage, meal and rest period requirements, tip credits, tip pooling, service charges, gratuities, and independent contractor issues.

Restrictive Covenants & Trade Secrets

  • Represents businesses in disputes involving trade secret misappropriation, unfair competition, and restrictive covenants/non-compete agreements.
  • Advises employers on strategies to protect confidential information, customer relationships, proprietary business assets, and competitive business interests.
  • Guides employers through employee departures, competitor hiring, protection of trade secrets, and restrictive covenant compliance and enforcement.
  • Drafts and enforces restrictive covenant, confidentiality, and proprietary information agreements.

Harassment, Discrimination, & Retaliation

  • Represents employers in litigation and administrative proceedings against claims of harassment, discrimination, retaliation, and other wrongful employment practices.
  • Defends employers from claims arising under Title VII, the ADA, the ADEA, and similar federal, state, and local employment laws.
  • Conducts and directs sensitive workplace investigations involving allegations of harassment, discrimination, retaliation, and employee misconduct and/or policy violations.
  • Advises employers on workplace policies, employee complaints, accommodations, corrective action, and risk-management strategies designed to prevent employment claims.
  • Provides practical guidance on compliance with equal employment opportunity and anti-harassment requirements.

 Employment Counseling

  • Serves as trusted employment counsel to employers on day-to-day personnel, compliance, and employee relations matters.
  • Advises employers on the full range of workplace issues, from recruiting and hiring to employee discipline, leaves of absence, accommodations, workplace investigations, and terminations.
  • Guides employers through workforce restructurings, reductions in force, WARN Act compliance, and other complex employment transitions.
  • Drafts and reviews employment agreements, separation agreements, employee handbooks, workplace policies, restrictive covenants, and related employment documentation.
  • Provides guidance on evolving workplace issues, including marijuana laws, drug and alcohol testing, leave management, wage and hour compliance, and multistate employment law requirements.
  • Conducts workplace training and develops compliance and risk-management strategies designed to prevent employment disputes and litigation.

Employment Litigation

  • Represents employers in employment litigation, arbitration, and administrative proceedings involving discrimination, harassment, retaliation, wage and hour, leave, accommodation, and restrictive covenant claims.
  • Defends employers in class, collective, and complex litigation matters arising under federal, state, and local employment laws.
  • Obtains favorable results through motion practice, mediation, arbitration, and trial.
  • Develops litigation and risk-management strategies designed to protect business interests and achieve favorable outcomes.

Representative Experience

  • Obtained dismissal on behalf of a hospitality company based on lack of standing in a lawsuit brought by a guest alleging disability discrimination under Title III of the ADA.
  • Obtained default judgment against a former employee and new employer for destruction of evidence and misappropriation of company trade secrets.
  • Obtained summary judgment on behalf of an employer on an employee’s hostile work environment claim with novel allegations of workplace bullying.
  • Prevailed on a motion to dismiss on behalf of a hospital against an employee’s claims asserting private right of action under the OSH Act and secured an award of sanctions.
  • Defended a retail company in a wage and hour class action against sales associates alleging the novel theory of failing to properly compensate “manual workers” under New York Labor Law.
  • Obtained a summary judgment on behalf of an employer on an employee’s hostile work environment claim with novel allegations of workplace bullying.
  • Prevailed on a motion to dismiss on behalf of a hospital against an employee’s claims asserting private right of action under the OSH Act and secured an award of sanctions.
  • Defended hotel ownership and management groups, restaurants, and retail stores in lawsuits alleging that their websites were inaccessible to individuals with disabilities and failed to comply with the ADA and Web Content Accessibility Guidelines (WCAG).  
  • Defended an amusement park in a lawsuit concerning compliance with child labor, overtime, meal break, and regular rate of pay calculations.
  • Defended companies against religious and disability discrimination claims based on the COVID-19 vaccine mandate.

Outside the Office

Jordan lives in the Washington, DC area and is an avid tennis player and golfer.
