New York recently enacted Labor Law Section 27-F, which will require employers that are already federally mandated to maintain first-aid supplies in their workplaces to now include an opioid antagonist with those first-aid supplies.
The original bill, S.B. 5922-A, was enacted on Dec. 12, 2025, and subsequent amendments were passed by way of A.B. 9453 at the request of Gov. Kathy Hochul.
Hochul signed the amended bill on Feb. 13, and the law will take effect on Dec. 12. The law creates challenges for employers, as it is subject to an Occupational Safety and Health Administration analysis that is far from clear. This not only creates compliance challenges for employers, but also enforcement challenges for the New York State Department of Labor.
