{"id":8144,"date":"2024-02-20T09:15:04","date_gmt":"2024-02-20T14:15:04","guid":{"rendered":"https:\/\/oshadefensereport.com\/?p=8144"},"modified":"2026-03-20T13:27:26","modified_gmt":"2026-03-20T17:27:26","slug":"osha-sends-proposed-final-worker-walkaround-representative-designation-process-rule-to-omb","status":"publish","type":"post","link":"https:\/\/www.connmaciel.com\/osha-defense-report\/osha-sends-proposed-final-worker-walkaround-representative-designation-process-rule-to-omb\/","title":{"rendered":"OSHA Sends Proposed Final &#8220;Worker Walkaround Representative Designation Process&#8221; Rule to OMB"},"content":{"rendered":"<p><em><strong>By <a href=\"https:\/\/www.connmaciel.com\/conn\" target=\"_blank\" rel=\"noopener\">Eric Conn<\/a>, <a href=\"https:\/\/www.connmaciel.com\/trapp\" target=\"_blank\" rel=\"noopener\">Mark Trapp<\/a>, and <a href=\"https:\/\/www.connmaciel.com\/rohani-shukla\" target=\"_blank\" rel=\"noopener\">Darius Rohani-Shukla<\/a><\/strong><\/em><\/p>\n<p>In early 2023, OSHA revealed plans for a rulemaking for a Worker Walkaround Representative Designation Process Rule that would amend existing regulation <a href=\"https:\/\/www.osha.gov\/laws-regs\/regulations\/standardnumber\/1903\/1903.8\" target=\"_blank\" rel=\"noopener\">29 CFR \u00a7 1903.8(c)<\/a>, which governs participation by third parties in OSHA inspections as employee representatives. The proposed rule changes three key components of that regulation:<\/p>\n<ol>\n<li>Changing the existing language that historically has generally limited employee representation during an OSHA inspection to individuals who are employees of the employer that is being inspected, to now <em>allow non-employee third parties<\/em> to act as employee representatives during OSHA inspections.<\/li>\n<li>Expanding the types of third parties permitted to represent employees during OSHA inspections. The existing regulation focuses on non-employees with a technical credential, \u201csuch as an industrial hygienist or a safety engineer\u201d to accompany OSHA on an inspection when it \u201cis reasonably necessary to the conduct of an effective and thorough physical inspection of the workplace[.]\u201d The new Proposal eliminates the limitation to these technical experts, <a href=\"http:\/\/oshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/3\/2024\/02\/Worker-Walkaround-Rulemaking.jpg\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" title=\"Worker Walkaround Rulemaking 300x166\" class=\"alignright wp-image-8159\" src=\"http:\/\/oshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/3\/2024\/02\/Worker-Walkaround-Rulemaking-300x166.jpg\" alt=\"Worker Walkaround Rulemaking 300x166\" width=\"469\" height=\"260\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2024\/02\/Worker-Walkaround-Rulemaking-300x166.jpg 300w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2024\/02\/Worker-Walkaround-Rulemaking-1024x565.jpg 1024w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2024\/02\/Worker-Walkaround-Rulemaking-768x424.jpg 768w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2024\/02\/Worker-Walkaround-Rulemaking.jpg 1360w\" sizes=\"(max-width: 469px) 100vw, 469px\" \/><\/a>and indicates that a third party representative may be \u201creasonably necessary\u201d because of \u201crelevant knowledge, skills, or experience with hazards or conditions in the workplace or similar workplaces, or language skills.\u201d<\/li>\n<li>The proposed rule may also expand the role these third party representatives play during an OSHA inspection. The OSH Act and the existing regulation speak in terms of the representative \u201caccompanying\u201d OSHA during the walkaround phase of the inspection, but the proposed amended rule introduces the term \u201cparticipate,\u201d which could mean OSHA intends for these third parties to have a more active role; e.g., attending and asking questions during private employee interviews, reviewing the employer\u2019s records produced to OSHA pursuant to OSHA&#8217;s broad subpoena authority, etc.<\/li>\n<\/ol>\n<p><!--more--><\/p>\n<p>There have been several major concerns with this proposed rule.\u00a0 The biggest ones are who OSHA would be welcoming into private workplaces over the objections of employers.\u00a0 Although masquerading as an OSHA regulation, the real reason OSHA is promulgating this rule is to make it easier for unions to get access to non-union workplaces.\u00a0 But that is not the most concerning set of interlopers for whom OSHA could be opening your doors.\u00a0 Plaintiffs&#8217; attorneys and their &#8220;experts,&#8221; have been trying for decades to get early, unfettered access to workplaces after injuries.\u00a0 Disgruntled former employees are often the instigator of OSHA inspections, and would surely love to come in and wreak havoc with an OSHA compliance officer.\u00a0 Family members or injured workers, media, competitors, and community and activist groups could also take advantage of OSHA&#8217;s new regulation.<\/p>\n<p>Conn Maciel Carey\u2019s national <a href=\"https:\/\/www.connmaciel.com\/osha-workplace-safety\" target=\"_blank\" rel=\"noopener\">OSHA Practice<\/a> and <a href=\"https:\/\/www.connmaciel.com\/labor-and-employment\" target=\"_blank\" rel=\"noopener\">Labor &amp; Employment Practice<\/a> formed the <em>Employers Walkaround Representative Rulemaking Coalition<\/em>, composed of a diverse group of employers and trade associations representing many industries with millions of employees across thousands of workplaces in every state in the US, to advocate to OSHA to set aside this proposal or to at least set it up to operate reasonably. We are happy to help with coordinating and preparing talking points for such a meeting.<\/p>\n<p>Another update about this rulemaking you may find interesting.\u00a0 The House of Representatives Committee with oversight over OSHA (the Education and Workforce Committee) has joined Industry in pressing OSHA to withdraw the Worker Walkaround Rulemaking.\u00a0 In September, Assistant Secretary Doug Parker was grilled about the lawfulness and wisdom of this proposed rule at a public hearing, and then sent OSHA a series of written questions.\u00a0 Here is a <a href=\"https:\/\/docs.house.gov\/meetings\/ED\/ED10\/20230927\/116336\/HHRG-118-ED10-20230927-QFR001.pdf\" target=\"_blank\" rel=\"noopener\">link to those written questions and OSHA\u2019s answers<\/a>. One notable Q&amp;A relates to one of the other major issues we flagged in our written comments \u2013 <em>what is the problem for which this rule is intended as a solution?<\/em>\u00a0 Specifically, what evidence has OSHA seen of employees requesting and being denied an appropriate third-party inspection representative?\u00a0 OSHA responded to that question by noting that it does not track that and is not aware of any such instances. Administrative Law generally requires there to be a problem to be solved for a regulation to be lawful.<a href=\"https:\/\/edworkforce.house.gov\/uploadedfiles\/final_02.12.24_proposed_osha_walkaround_rule.pdf\"><img loading=\"lazy\" decoding=\"async\" title=\"House Committee Letter 300x270\" class=\"alignright wp-image-8157\" src=\"http:\/\/oshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/3\/2024\/02\/House-Committee-Letter-300x270.jpg\" alt=\"House Committee Letter 300x270\" width=\"401\" height=\"361\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2024\/02\/House-Committee-Letter-300x270.jpg 300w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2024\/02\/House-Committee-Letter.jpg 596w\" sizes=\"(max-width: 401px) 100vw, 401px\" \/><\/a><\/p>\n<p>On that issue, last week, the majority on the House Education and Workforce Committee sent <a href=\"https:\/\/edworkforce.house.gov\/uploadedfiles\/final_02.12.24_proposed_osha_walkaround_rule.pdf\">a letter to Labor Secretary Julie Su<\/a> requesting that DOL abandon the proposed Worker Walkaround rule in its entirety. Chairwoman Foxx expressed concerns about the Department\u2019s inability thus far to support the proposed rule with any sound data or qualitative analysis:<\/p>\n<blockquote><p>&#8220;<em>OSHA\u2019s QFR responses make clear that it proceeded to undertake fundamental changes to its current walkaround regulation4 without any substantive data or an understanding of whether changes to its regulation are needed. After the hearing, Committee QFRs requested data detailing how many times a third-party representative accompanied inspectors as the representative of an employee during a worksite inspection for Fiscal Years 2019-2023.
