Mitchell<\/em><\/a><\/p>\n<p>On May 30, 2023, the US Court of Appeals for the Eleventh Circuit issued an opinion in the case of <a href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202211626.pdf\" target=\"_blank\" rel=\"noopener\"><em>Chewy, Inc. v. the US Department of Labor<\/em><\/a> that is very important for US retailers and others who manage warehouses and major forklift operations.<\/p>\n<p><a href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202211626.pdf\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" title=\"Picture1 1 300x286\" class=\" wp-image-7330 alignright\" src=\"http:\/\/oshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/3\/2023\/06\/Picture1-1-300x286.png\" alt=\"Picture1 1 300x286\" width=\"365\" height=\"348\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/06\/Picture1-1-300x286.png 300w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/06\/Picture1-1.png 329w\" sizes=\"(max-width: 365px) 100vw, 365px\" \/><\/a>The case involves a May 2019 OSHA citation issued to Chewy, Inc., a pet products online retailer, alleging a violation of the OSH Act\u2019s General Duty Clause for the retailer failing to protect its warehouse employees from an \u201cunder-ride\u201d hazard, which occurs when the lowest cross bar of a warehouse storage rack is high enough to allow a forklift to drive underneath, but low enough that upon driving underneath, it can pin the forklift operator between the cross bar and the seat\/cab of the forklift. \u00a0The citation arose out of a December 16, 2018, incident at Chewy\u2019s Ocala, FL warehouse, when a standup forklift operator died by asphyxiation after becoming pinned between the forklift and a metal storage rack. \u00a0This was the second under-ride incident at Chewy\u2019s warehouse in a six-month period, although the first under-ride incident was not fatal. \u00a0In the Ocala warehouse, <!--more-->the rack\u2019s lowest level was 54.5 inches, which was taller than the forklift\u2019s highest point of 51 inches. The rack was therefore not low enough to prevent the forklift from being driven under the lowest shelf.<\/p>\n<p>OSHA issued a General Duty Clause citation after determining through the inspection that Chewy had met its obligations under OSHA\u2019s Powered Industrial Truck Standard \u2013 29 C.F.R. \u00a7 1910.178 et seq. \u2013 but did not otherwise eliminate the potential under-ride hazard by taking measures beyond what the PIT standard required, namely, implementing engineering changes to the storage racks or the forklift.<\/p>\n<p>An OSH Review Commission administrative law judge affirmed the General Duty Clause citation reasoning that because compliance with OSHA\u2019s PIT standard might not prevent all under-ride hazards, Chewy was not excused from its general duty to protect workers from the hazard. \u00a0Moreover, the ALJ found that Chewy did not fulfill its general duty to maintain a workplace free from recognized hazards because under-rides were a known hazard in the industry and Chewy did not adopt certain preventive measures\u2014modifying its forklifts or modifying its warehouse shelving to ensure that the forklift would hit the shelf and not be able to pass under the shelf.<\/p>\n<p>The dispute ended up on appeal before the US Court of Appeals for the Eleventh Circuit with the central question whether the OSH Act\u2019s General Duty Clause was preempted by OSHA&#8217;s specific PIT standard at 29 C.F.R. \u00a7 1910.178 et seq., which was designed to regulate safe operation of forklifts in warehouses and other work settings. \u00a0 During the appeal, Chewy, along with the <a href=\"https:\/\/www.rila.org\/retail-litigation-center\">Retail Litigation Center<\/a> as <a href=\"https:\/\/a21db1a9-ee86-4e05-b156-738012d7b87e.filesusr.com\/ugd\/460460_4a64f367841640b8b8e9048d7d3aa4f6.pdf\" target=\"_blank\" rel=\"noopener\"><em>amicus curiae<\/em><\/a>, argued that OSHA\u2019s PIT standard preempted the General Duty Clause because the PIT standard has several requirements that were intended to prevent the under-ride hazard.\u00a0 <a href=\"https:\/\/a21db1a9-ee86-4e05-b156-738012d7b87e.filesusr.com\/ugd\/460460_4a64f367841640b8b8e9048d7d3aa4f6.pdf\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" title=\"Picture2 297x300\" class=\"alignright wp-image-7331\" src=\"http:\/\/oshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/3\/2023\/06\/Picture2-297x300.png\" alt=\"Picture2 297x300\" width=\"363\" height=\"366\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/06\/Picture2-297x300.png 297w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/06\/Picture2-150x150.png 150w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/06\/Picture2-167x167.png 167w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/06\/Picture2.png 341w\" sizes=\"(max-width: 363px) 100vw, 363px\" \/><\/a>For example, the PIT standard has extensive training requirements addressing safe maneuvering of forklifts around fixed equipment, like warehouse storage racks, and specific requirements for how to safely operate a forklift in those settings, like duties to look in the direction of travel, maintain control of the forklift, and operate the forklift at safe speeds.\u00a0 OSHA\u2019s standards also set requirements for maintaining wide enough aisles for forklifts to safely maneuver.<\/p>\n<p>The theory of OSHA\u2019s case was essentially that the PIT standard was not specifically designed to address the under-ride hazard, or at least the manner in which the PIT standard address the under-ride hazard was insufficient, so OSHA could hold employers accountable for not taking steps beyond what the standard required.<\/p>\n<p>On May 30, 2023, the Eleventh Circuit issued its opinion, and overturned the ALJ, now vacating the General Duty Clause citation.\u00a0 The court reasoned that the General Duty Clause was preempted by OSHA\u2019s PIT standard.\u00a0 Specifically, that OSHA\u2019s training and safe PIT operation provisions of the PIT standard (29 C.F.R. \u00a7 1910.178(l) and (n)) were intended to address the under-ride hazard, regardless whether it did so effectively.\u00a0 The Eleventh Circuit rejected OSHA\u2019s and the ALJ\u2019s theory that training cannot eliminate the under-ride hazard because even if the PIT training and traveling standards were followed, the under-ride hazard would exist in the workplace because of inattention or inadvertence. \u00a0In rejecting this reasoning, the Eleventh Circuit held that the \u201cSecretary could avoid preemption of any standard by distinguishing between the hazards the standard addresses and the hazards that occur when the standard fails.\u201d<\/p>\n<p>Citing to the Retail Litigation Center\u2019s <em>amicus<\/em> brief prepared in conjunction with the <a href=\"http:\/\/www.connmaciel.com\/osha-workplace-safety\">national OSHA Practice at Conn Maciel Carey LLP<\/a>, the Eleventh Circuit explained:<\/p>\n<blockquote><p><em>&#8220;The Secretary\u2019s distinction between a standard that prevents the under-ride hazard and a standard that addresses the hazards that arise in the event of an under-ride, if accepted and extended to other cases, would upend the regulatory scheme. The Secretary could avoid preemption of any standard by distinguishing between the hazards the standard addresses and the hazards that occur when the standard fails. Instead, as amicus curiae the Retail Litigation Center, Inc., explains, if the Secretary determines that current standards \u201care inadequate to address the under-ride hazard, the [Occupational Safety and Health] Act provides the agency with legal authority to impose new requirements on the industry.\u201d The Secretary can modify the safety standards through public notice and comment. See 29 U.S.C. \u00a7 655(b). That process, as the Retail Litigation Center explains, provides the Secretary with critical input from interested parties about the \u201cfeasibility, potential risk reduction, and\/or unintended impacts\u201d of proposed standard revisions.<\/em><\/p>\n<p><em>But if the inadequacy of the existing standards precludes preemption, the Secretary can use the general-duty clause to update specific safety standards without the required procedural safeguards.&#8221;<\/em><\/p><\/blockquote>\n<p>This Eleventh Circuit opinion is a big win for warehouse operators at a very important time relative to OSHA enforcement.\u00a0 Warehouse safety enforcement has become a high priority for OSHA.\u00a0 <a href=\"https:\/\/oshadefensereport.com\/2022\/08\/10\/regional-emphasis-program-for-warehousing-operations\/\"><img loading=\"lazy\" decoding=\"async\" title=\"Warehouse Rep 300x266\" class=\"alignright wp-image-7340\" src=\"http:\/\/oshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/3\/2023\/06\/Warehouse-REP-300x266.jpg\" alt=\"Warehouse Rep 300x266\" width=\"377\" height=\"334\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/06\/Warehouse-REP-300x266.jpg 300w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/06\/Warehouse-REP.jpg 574w\" sizes=\"(max-width: 377px) 100vw, 377px\" \/><\/a>Three of OSHA\u2019s ten Regions already have an <a href=\"https:\/\/oshadefensereport.com\/2022\/08\/10\/regional-emphasis-program-for-warehousing-operations\/\" target=\"_blank\" rel=\"noopener\">active enforcement Regional or Local Emphasis Program focused on warehouse safety<\/a>, and six OSHA Regions have <a href=\"https:\/\/www.osha.gov\/sites\/default\/files\/enforcement\/directives\/CPL_04-00-023G.pdf\" target=\"_blank\" rel=\"noopener\">Emphasis Programs focused on forklift operations<\/a>.\u00a0 On top of that, OSHA has indicated that this year it will be launching a Warehouse Safety National Emphasis Program.<\/p>\n<p>With the outcome in <em>Chewy, Inc. v. Dept. of Labor<\/em>, OSHA may not be able to use the General Duty Clause to force warehouse operators to redesign their warehouse storage equipment or retrofit their fleet of powered industrial trucks, but it will make OSHA hyper-aggressive enforcing the requirements of the Powered Industrial Truck Standard.\u00a0 So employers with significant warehouse operations and fleets of forklifts need to ensure their PIT safety program is hitting on all cylinders.\u00a0 Having a third party review the program and audit your warehouse operations before OSHA knocks on the door would also be advisable.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Eric J.
