Deacon<\/a><\/strong><\/em><\/p>\n<p>We have an update to share about OSHA\u2019s rulemaking to expand its regulation to &#8220;Improve Tracking of Workplace Injuries and Illnesses&#8221; (known better as the Electronic Recordkeeping or E-Recordkeeping Rule).\u00a0 Late last week, OSHA delivered to the White House\u2019s Office of Management and Budget (OMB) a proposed Final (Amended) E-Recordkeeping Rule for review by the Administration\u2019s economists and policy experts.\u00a0 <a href=\"https:\/\/www.reginfo.gov\/public\/do\/eoReviewSearch\">OMB\u2019s website<\/a> reflects that, as of April 7, 2023, OMB:<\/p>\n<ul>\n<li>Has received a proposed E-Recordkeeping Rule from OSHA; and<\/li>\n<li>The rule is in the \u201cFinal Rule\u201d stage.<a href=\"https:\/\/www.reginfo.gov\/public\/do\/eoDetails?rrid=309563\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" title=\"Erecordkeeping To Omb 300x132\" class=\"alignright wp-image-7097 \" src=\"http:\/\/oshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/3\/2023\/04\/ERecordkeeping-to-OMB-300x132.png\" alt=\"Erecordkeeping To Omb 300x132\" width=\"423\" height=\"187\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/04\/ERecordkeeping-to-OMB-300x132.png 300w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/04\/ERecordkeeping-to-OMB-768x339.png 768w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/04\/ERecordkeeping-to-OMB.png 964w\" sizes=\"(max-width: 423px) 100vw, 423px\" \/><\/a><\/li>\n<\/ul>\n<p>As we indicated a few weeks ago, OSHA\u2019s <a href=\"https:\/\/oshadefensereport.com\/2023\/02\/02\/e-recordkeeping-rule-update-for-coalition\/\">latest target date to issue the rule<\/a> is June of this year, and getting the proposed final rule to OMB last week lines up well with that target. \u00a0The submission of the proposed rule to OMB means OSHA is at the goal line; just one step away from finalizing a rule that more closely resembles the agency\u2019s original intent and broad scope of the E-Recordkeeping Rule when it was promulgated in 2016 under the Obama Administration.<\/p>\n<p>The original E-Recordkeeping Rule would have had larger employers submitting to OSHA annually the data from their full panoply of injury and illness recordkeeping forms (the 300 Logs, 301 incident reports, and 300A Annual Summaries), and smaller employers in certain \u201chigh hazard industries\u201d submitting only the 300A Annual Summary data.\u00a0 Before ever collecting the more detailed level data from 300 Logs and 301 Incident Reports, former <a href=\"https:\/\/oshadefensereport.com\/2022\/04\/04\/oshas-rulemaking-to-expand-the-electronic-recordkeeping-rule\/\">President Trump\u2019s OSHA rolled back the more onerous requirements<\/a>, such that no matter the employer\u2019s size, if you were covered by the rule, you submitted only 300A Annual Summary date.<\/p>\n<p>OSHA was sued by organizations representing labor alleging that<!--more--> the rollback of the more onerous E-Recordkeeping requirements was arbitrary and capricious <em>(State of New Jersey, et al., v. Walsh<\/em>).\u00a0 Before that legal challenge could heard, the Biden Administration took the reigns at OSHA and asked the DC District Court to stay the legal challenge on a promise that OSHA was working diligently to rollback the Trump rollbacks on its own initiative.\u00a0 That case has been stayed, but OSHA missed several deadlines it represented to the court to finalize the proposed revisions to the E-Recordkeeping Rule, most recently its commitment to finalize the rule before the March 2023 deadline for employers to submit their 2022 injury data to OSHA.\u00a0 OSHA\u2019s delays prompted the pro-labor challengers to ask the federal district court to reactivate the case.\u00a0 OSHA replied to that motion committing to that June 2023 target date, which it appears it is likely to meet.<\/p>\n<p>In the early days of the Biden Administration, <a href=\"https:\/\/oshadefensereport.com\/2022\/04\/04\/oshas-rulemaking-to-expand-the-electronic-recordkeeping-rule\/\">OSHA published in the Federal Register its intent to amend the E-Recordkeeping Rule<\/a> and described the changes it was considering. \u00a0Those changes seek not only to restore the requirement from the original 2016 rule to have larger employers submit the full array of recordkeeping data (i.e., data from 300 Logs, 301 incident reports, and the 300A annual summaries), but also to expand the number of employers that must submit any level of data by lowering the threshold number of employees from 250 to 100 and by expanding the list of covered high-hazard industries.\u00a0\u00a0Specifically, under the proposed amendments to the E-Recordkeeping Rule: <img loading=\"lazy\" decoding=\"async\" title=\"E Recordkeeping Proposal In Federal Register 300x281\" class=\" wp-image-7099 alignright\" src=\"http:\/\/oshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/3\/2023\/04\/E-Recordkeeping-Proposal-in-Federal-Register-300x281.webp\" alt=\"E Recordkeeping Proposal In Federal Register 300x281\" width=\"342\" height=\"320\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/04\/E-Recordkeeping-Proposal-in-Federal-Register-300x281.webp 300w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2023\/04\/E-Recordkeeping-Proposal-in-Federal-Register.webp 641w\" sizes=\"(max-width: 342px) 100vw, 342px\" \/><\/p>\n<ul>\n<li>The current requirement for\u00a0all establishments with more than <em>250 or more employees<\/em>in <em>any industry<\/em> to electronically submit <em>only 300A data<\/em> would be replaced by a new requirement for establishments with <em>100 or more employees<\/em> only in certain so-called <em>\u201chigh hazard industries\u201d<\/em> (as reflected in new\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/03\/30\/2022-06546\/improve-tracking-of-workplace-injuries-and-illnesses#p-196\">Appendix B<\/a>) to annually submit to OSHA via an electronic portal the <em>data from their 300 Logs, 301 Incident Reports, and 300A Annual Summaries<\/em>;<\/li>\n<li>Establishments with <em>20 or more employees<\/em> in a separate list of <em>high-hazard industries<\/em> will still be required to electronically submit information only from their <em>300A Annual Summaries<\/em>, but the list of covered industries in this category is expanded per\u00a0<a href=\"https:\/\/www.federalregister.gov\/d\/2022-06546\/p-125\">new Appendix A<\/a>; and<\/li>\n<li>All submitting establishments must also now include their proper legal company name (rather than a dba or informal descriptor).<\/li>\n<\/ul>\n<p>OMB\u2019s Office of Information and Regulatory Affairs (OIRA) will take further stakeholder input through meetings with representatives from OMB and OSHA.\u00a0 Conn Maciel Carey<em>&#8216;s &#8220;Employers E-Recordkeeping Coalition&#8221;<\/em> has been working hard to make sure Industry\u2019s voice has been heard in this rulemaking process as far back as the original rulemaking during the Obama Administration.\u00a0 As a reminder, on behalf of our Coalition, we submitted a comprehensive set of <a href=\"https:\/\/oshadefensereport.com\/2022\/07\/25\/the-employers-e-recordkeeping-coalition-submits-comprehensive-written-comments-to-oshas-e-recordkeeping-rulemaking-docket\/\">written comments when President Biden\u2019s OSHA proposed these amendments<\/a> last year.<\/p>\n<p>One element of the final OMB review process is that OMB\u2019s Office of Information and Regulatory Affairs (OIRA) often takes stakeholder input in some form, pursuant to Executive Order 12866.\u00a0 Most often, that input is in the form of stakeholder meetings with representatives from OMB and the agency promulgating the rule \u2013 OSHA for our purposes.\u00a0 Likewise, stakeholders may submit any form of written advocacy, exhibits, data, etc. in connection with their EO 12866 meetings. \u00a0We intend to continue to advocate for a reasonable E-Recordkeeping Rule by submitting a request for a stakeholder meeting on behalf of the <em>Employers E-Recordkeeping Coalition<\/em>.<\/p>\n<p>In the meantime, if you have any questions about OSHA&#8217;s E-Recordkeeping Rule, the status of the rulemaking, or any OSHA issues, please feel free to reach out.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Eric J.
