Hears Oral Argument in Challenge to Biden&#8217;s EO for a Federal Contractor COVID-19 Vaccine-Mandate"},"content":{"rendered":"<p><em><strong>By Conn Maciel Carey&#8217;s <a href=\"http:\/\/www.connmaciel.com\/covid-19-taskforce\" target=\"_blank\" rel=\"noopener\">COVID-19 Task Force<\/a><\/strong><\/em><\/p>\n<p>This past Friday, April 8, 2022, the US Court of Appeals for the Eleventh Circuit heard oral argument in <em>Georgia v. Biden<\/em>, one of the legal challenges to President Biden\u2019s Executive Order imposing a hard <a href=\"https:\/\/oshadefensereport.com\/2021\/11\/19\/update-on-challenges-to-federal-contractor-mandate\/\" target=\"_blank\" rel=\"noopener\">vaccine-mandate on federal contractors<\/a>.\u00a0 This was the first of several challenges to the federal contractor vaccination mandate to be heard at the US Court of Appeals level, and this particular challenge reaches the 11<sup>th<\/sup> Circuit with a rare <em>nationwide <\/em>temporary injunction imposed at the district court level.<\/p>\n<p><a href=\"https:\/\/www.ca11.uscourts.gov\/oral-argument-recordings\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" title=\"Capture 4 300x236\" class=\" wp-image-5984 alignright\" src=\"http:\/\/oshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/3\/2022\/04\/Capture-4-300x236.png\" alt=\"Capture 4 300x236\" width=\"405\" height=\"318\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2022\/04\/Capture-4-300x236.png 300w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2022\/04\/Capture-4.png 591w\" sizes=\"(max-width: 405px) 100vw, 405px\" \/><\/a>There\u2019s a link to the recording of the 11<sup>th<\/sup> Circuit argument on this page\u00a0\u2013 <a href=\"https:\/\/www.ca11.uscourts.gov\/oral-argument-recordings\">https:\/\/www.ca11.uscourts.gov\/oral-argument-recordings<\/a>.\u00a0 Scroll down to docket number\u00a021-14269.\u00a0 The recording is difficult to load, it stops and starts, and the sound quality is uneven, so if you don\u2019t want to subject yourself to that, here is a summary of the argument and our best effort to read the tea leaves.<\/p>\n<p>During this hearing, the three-judge panel was most interested in two aspects of the dispute:<!--more--><\/p>\n<ol>\n<li style=\"list-style-type: none\">\n<ol>\n<li>The extent of the President&#8217;s powers under the\u00a0Procurement\u00a0Act; and<\/li>\n<li>Whether\u00a0the District Court abused its discretion in issuing a nationwide\u00a0injunction.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p>On the first point, it sounded as if the judges were hoping for more precedent or better facts than had been supplied in the briefs. \u00a0The federal government argued that there is a &#8220;genuinely close nexus&#8221; between the statute and executive order 14042, because vaccinations will reduce the level of absenteeism, sick leave, and delays in federal contracting. \u00a0Whereas the attorneys for the challenging States and the trade association argued that there is a\u00a0complete absence of precedent for a sweeping executive order that forces a medical procedure on a substantial portion of the national workforce &#8211; a social\u00a0policy\u00a0in the guise of contracting terms.<\/p>\n<p>Two judges seemed receptive to the federal government&#8217;s position that the COVID-19\u00a0vaccination mandate for\u00a0federal contractors is similar to requirements that are more burdensome but which survived previous legal challenges; e.g., anti-discrimination and minimum wage.<\/p>\n<p>Although the\u00a011<sup>th<\/sup> Circuit had already denied a motion by the federal government in December 2021 to limit the nationwide-scope of the preliminary injunction, at this hearing, it sounded as if they are now inclined to\u00a0limit the scope of the\u00a0injunction, acknowledging that national injunctions are quite rare, and the arguments made by the States and the Association of Builders and Contractors were \u201crather thin.\u201d\u00a0 Judge Pryor said he could see both sides of the case \u2013 telling the Department of Justice attorney: \u201cI don&#8217;t think you are wrong, but that I am not sure you are right.\u201d\u00a0 Though\u00a0he also said it would &#8220;troubling&#8221; to\u00a0maintain the nationwide mandate, giving relief to those who did not ask for it, who may prefer to require their employees to be vaccinated for COVID-19.<\/p>\n<p>Overall, it is our impression that it is likely that the national injunction will be scaled back to apply only to the parties before the court \u2013 the named States and members of a trade association.<\/p>\n<p>There are five other cases pending in different\u00a0federal courts where more limited injunctions are in force.\u00a0 If the national injunction is lifted in this Georgia case, the federal\u00a0government may well decide to maintain the <em>status quo<\/em> \u2013 that is, no enforcement actions will be taken while the fate of EO 14042 remains uncertain \u2013 but the\u00a0federal government could take a patchwork approach, as it did with regard to the vaccination mandate under the CMS Rule as it moved through the lower courts on its way to the Supreme Court.<\/p>\n<p>We will keep a close out for the decision from the 11<sup>th<\/sup> Circuit and will share an update when we see it.\u00a0 In the meantime, let us know if you have any questions.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Conn Maciel Carey&#8217;s COVID-19 Task Force This past Friday, April 8, 2022, the US Court of Appeals for the Eleventh Circuit heard oral argument in Georgia v.
