{"id":3061,"date":"2020-08-21T19:25:16","date_gmt":"2020-08-21T23:25:16","guid":{"rendered":"http:\/\/oshadefensereport.com\/?p=3061"},"modified":"2026-03-16T20:01:41","modified_gmt":"2026-03-16T20:01:41","slug":"michigan-osha-launches-covid-19-enforcement-emphasis-program-targeting-retail-and-restaurants","status":"publish","type":"post","link":"https:\/\/www.connmaciel.com\/osha-defense-report\/michigan-osha-launches-covid-19-enforcement-emphasis-program-targeting-retail-and-restaurants\/","title":{"rendered":"Michigan OSHA Launches COVID-19 Enforcement Emphasis Program Targeting Retail and Restaurants"},"content":{"rendered":"\n<p>By Conn Maciel Carey&#8217;s <a href=\"http:\/\/www.connmaciel.com\/covid-19-taskforce\" target=\"_blank\" rel=\"noreferrer noopener\">COVID-19 Task Force<\/a><\/p>\n\n\n\n<p>Over the course of the last month, several of our retail clients have been visited by Michigan OSHA (MIOSHA) for COVID-19 enforcement inspections in circumstances without an employee complaint or any self-reported work-related COVID-19 hospitalization or death.\u00a0 The reason for these inspections, it turns out, is MIOSHA has launched a <a href=\"https:\/\/adms.apps.lara.state.mi.us\/File\/ViewDmsDocument\/13371?utm_medium=email&amp;utm_source=govdelivery\" target=\"_blank\" rel=\"noreferrer noopener\">State Emphasis Program (SEP) on COVID-19 in Bars, Restaurants, Gas Stations, Grocery and Convenience Stores, and Other Retail<\/a>.\u00a0 We got our hands on the <a href=\"https:\/\/adms.apps.lara.state.mi.us\/File\/ViewDmsDocument\/13371?utm_medium=email&amp;utm_source=govdelivery\" target=\"_blank\" rel=\"noreferrer noopener\">Directive for the Emphasis Program<\/a>. Here\u2019s a summary of what Michigan employers in those industries need to know about MIOSHA&#8217;s new enforcement strategy.<\/p>\n\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-large is-resized\"><a href=\"https:\/\/adms.apps.lara.state.mi.us\/File\/ViewDmsDocument\/13371?utm_medium=email&amp;utm_source=govdelivery\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-3065\" src=\"https:\/\/oshadefensereport.com\/wp-content\/uploads\/2020\/08\/miosha-sep.png?w=1024\" alt=\"\" width=\"389\" height=\"339\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2020\/08\/miosha-sep.png 1927w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2020\/08\/miosha-sep-300x262.png 300w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2020\/08\/miosha-sep-1024x895.png 1024w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2020\/08\/miosha-sep-768x671.png 768w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2020\/08\/miosha-sep-1536x1342.png 1536w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2020\/08\/miosha-sep-1680x1468.png 1680w\" sizes=\"(max-width: 389px) 100vw, 389px\" \/><\/a><\/figure>\n<\/div>\n\n\n\n<p>The Directive lays out MIOSHA\u2019s approach for selecting various retail and hospitality workplaces for programmed inspections about COVID-19 infection control.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>The stated purposes of the Emphasis Program is to \u201cincrease MIOSHA\u2019s presence in retail establishments to ensure workers are protected from SARS-CoV-2,\u201d because \u201cemployees who come in contact with large numbers of people as a result of their employment [like in retail] are at elevated risk of infection.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>The inspections are evaluating the employer\u2019s adherence to <a href=\"https:\/\/www.michigan.gov\/coronavirus\/0,9753,7-406-98178_98455_98456_100804---,00.html\">Governor Whitmer\u2019s Executive Orders for COVID-19<\/a>, OSHA Guidance on Preparing Workplaces for COVID-19, and applicable CDC guidance for COVID-19.<\/p>\n\n\n\n<p>The agency has created a targeting list of retail\/hospitality businesses broken down as follows:<\/p>\n\n\n\n<p><!--more--><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Restaurants and bars \u2013 40%<\/li>\n<li>Gas stations and convenience stores \u2013 20%<\/li>\n<li>Grocery stores \u2013 20%<\/li>\n<li>Other retail \u2013 20%<\/li>\n<\/ul>\n\n\n\n<p>The scope of inspections conducted pursuant to this Directive is \u201cpartial,\u201d focusing only on COVID-19 and the risk of exposure to workers only (i.e., they are not supposed to evaluate infection control as it relates to customers and the general public.\u00a0 The inspections will likely include an on-site visit, a review of the establishment\u2019s COVID-19 written preparedness and response plan, and employee interviews and, according to the directive, \u201cshall ensure interviews are comprised of employees from all shifts.\u201d<\/p>\n\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-3068\" src=\"https:\/\/oshadefensereport.com\/wp-content\/uploads\/2020\/08\/miosha-interim-enforcement-plan-image.png?w=1024\" alt=\"\" width=\"388\" height=\"350\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2020\/08\/miosha-interim-enforcement-plan-image.png 1318w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2020\/08\/miosha-interim-enforcement-plan-image-300x271.png 300w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2020\/08\/miosha-interim-enforcement-plan-image-1024x925.png 1024w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2020\/08\/miosha-interim-enforcement-plan-image-768x694.png 768w\" sizes=\"(max-width: 388px) 100vw, 388px\" \/><\/figure>\n<\/div>\n\n\n\n<p>The compliance officers are expected to follow the citation procedures outlined in <a href=\"https:\/\/mcusercontent.com\/1f7d734e8deab2d2adeeace34\/files\/b3d7fabb-7d38-4848-b4c7-963c7f69d783\/MIOSHA_Interim_Enforcement_Plan.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">MIOSHA\u2019s COVID-19 Interim Enforcement Plan<\/a>.\u00a0<\/p>\n\n\n\n<p>Citations can be issued for a violation of the general duty clause of the MIOSH Act and applicable MIOSHA standards such as <a href=\"https:\/\/www.michigan.gov\/documents\/CIS_WSH_part33_34779_7.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">G.I. Part 33, Personal Protective Equipment<\/a>, <a href=\"https:\/\/www.michigan.gov\/documents\/CIS_WSH_part474_54646_7.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">G.I. Part 474, Sanitation<\/a>, and <a href=\"https:\/\/www.michigan.gov\/documents\/CIS_WSH_part451_54075_7.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">G.I. Part 451, Respiratory Protection<\/a>.
