Lashkari<\/a><\/p>\n<p>Earlier this week, on December 12, 2019, the U.S. Chemical Safety and Hazard Investigation Board (CSB) issued a <a href=\"https:\/\/www.federalregister.gov\/documents\/2019\/12\/12\/2019-26495\/accidental-release-reporting\">Notice of Proposed Rulemaking<\/a> (NPRM) for its long-awaiting chemical incident reporting rule, which sets out the circumstances when facility owners and operators are required to file reports with the CSB of accidental chemical releases and what must be communicated in the reports.<a href=\"https:\/\/www.federalregister.gov\/documents\/2019\/12\/12\/2019-26495\/accidental-release-reporting\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-2167\" style=\"margin-top:3px;margin-bottom:3px;margin-left:3px\" src=\"https:\/\/oshadefensereport.com\/wp-content\/uploads\/2019\/12\/csb-nprm.png?w=285\" alt=\"\" width=\"318\" height=\"335\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2019\/12\/csb-nprm.png 725w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2019\/12\/csb-nprm-285x300.png 285w\" sizes=\"(max-width: 318px) 100vw, 318px\" \/><\/a><\/p>\n<blockquote><p>As stated in the NPRM, the purpose of the rule is \u201cto ensure that the CSB receives rapid, accurate reports of any accidental release that meets established statutory criteria.\u201d<\/p><\/blockquote>\n<p>If promulgated, the rule would require owners and operators of stationary sources (chemical facilities) to report\u00a0 accidental releases that result in a fatality, serious injury, or substantial property damage to the CSB within four hours.\u00a0 The proposed rule also identifies the specific information required to be included in the accidental release report:<\/p>\n<ol>\n<li>A brief description of the accidental release;<\/li>\n<li>Whether the release resulted in a fire, explosion, death, serious injury, or property damage;<\/li>\n<li>The number of fatalities and\/or serious injuries, and the estimated property damage at or outside the stationary source;<\/li>\n<li>The name of the material involved;<\/li>\n<li>The amount of the release; and<\/li>\n<li>Whether the accidental release resulted in an evacuation order impacting members of the general public and other details associated with the evacuation.<\/li>\n<\/ol>\n<p>Importantly, recognizing that some or all of this information may not be known within four hours of an accidental release, the CSB decided to\u00a0 include the qualifier &#8212; \u201cif known\u201d &#8212; for much of the information that would be required in the report.<\/p>\n<p>If, however, the owner\/operator submits a report to <!--more-->the National Response Center (NRC) regarding the same release, the reporting obligation to the CSB may be satisfied by simply submitting the NRC identification number to the CSB immediately following submission of the report to the NRC.<\/p>\n<p>Because the CSB does not have its own enforcement authority, the proposed rule states that suspected violations of the reporting rule (i.e. failures to make a report, to make a timely report, or to provide complete and accurate information) will be referred to the Administrator of the Environmental Protection Agency (EPA) for appropriate enforcement action, and may result in administrative penalties in civil or criminal actions.\u00a0 The proposed rule does provide that owners and operators may revise and\/or update information already reported to the CSB (or NRC) without penalty.<img loading=\"lazy\" decoding=\"async\" class=\"alignright\" style=\"margin-top:3px;margin-bottom:3px;margin-left:3px\" src=\"https:\/\/www.safetyandhealthmagazine.com\/ext\/resources\/images\/news\/government\/logos\/US-ChemicalSafetyBoard-Logo.png?1561136033\" alt=\"Image result for csb\" width=\"307\" height=\"197\" \/><\/p>\n<p>Issuance of the CSB&#8217;s reporting rule has been a long time coming.\u00a0 Although the CSB did not become operational until 1998, its enabling legislation \u2013 the Clean Air Act Amendments (CAAA) \u2013 was enacted in 1990.\u00a0 That statute, from nearly thirty years ago, expressly required the CSB to issue a rule governing the reporting of accidental releases to the CSB.<\/p>\n<blockquote><p>Specifically, the CAAA required the CSB to \u201cestablish by regulation, requirements binding on persons for reporting accidental releases into the ambient air subject to the Board\u2019s investigatory jurisdiction.\u201d<\/p><\/blockquote>\n<p>Although the CSB submitted an Advanced Notice of Proposed Rulemaking for Chemical Release Reporting in 2009, that effort died on the vine.\u00a0 Accordingly, the CSB has never had its own reporting rule, relying instead on other sources to receive incident information.\u00a0 In February 2019, however, in a case brought by environmental activists, <a href=\"https:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=4&amp;ved=2ahUKEwiQ1ujdurXmAhWvuVkKHe7eD2wQFjADegQIBRAC&amp;url=https%3A%2F%2Fwww.courthousenews.com%2Fwp-content%2Fuploads%2F2019%2F02%2Fchem-ddc.pdf&amp;usg=AOvVaw0tpvuFdKfX381jtXTkjaga\" target=\"_blank\" rel=\"noopener\"><em>Air Alliance Houston, et al., v. U.S. Chemical and Safety Hazard Investigation Board<\/em>, 17-cv-02608 (D.D.C. 2019)<\/a>, a federal district court judge of the U.S. District Court for the District of Columbia<a href=\"https:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=4&amp;ved=2ahUKEwiQ1ujdurXmAhWvuVkKHe7eD2wQFjADegQIBRAC&amp;url=https%3A%2F%2Fwww.courthousenews.com%2Fwp-content%2Fuploads%2F2019%2F02%2Fchem-ddc.pdf&amp;usg=AOvVaw0tpvuFdKfX381jtXTkjaga\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-2172\" style=\"margin-top:3px;margin-bottom:3px;margin-left:3px\" src=\"https:\/\/oshadefensereport.com\/wp-content\/uploads\/2019\/12\/csb-case.png?w=300\" alt=\"\" width=\"371\" height=\"361\" srcset=\"https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2019\/12\/csb-case.png 717w, https:\/\/www.connmaciel.com\/osha-defense-report\/wp-content\/uploads\/sites\/3\/2019\/12\/csb-case-300x292.png 300w\" sizes=\"(max-width: 371px) 100vw, 371px\" \/><\/a> lambasted the CSB for what he characterized as \u201can egregious abdication of a statutory obligation\u201d to promulgate reporting regulations under the Clean Air Act Amendments of 1990.\u00a0 The Judge dismissed the CSB\u2019s arguments that the environmental groups lacked standing and held that the CSB did \u201cunreasonably delay\u201d action, having failed to promulgate regulations for nearly three decades.<\/p>\n<p>Ultimately, the Judge ordered the CSB to promulgate a final reporting rule, as had been mandated by the CAAA decades ago, within 12 months of the district court&#8217;s ruling &#8212; i.e., by mid-February 2020.<\/p>\n<p>The NPRM comes just a couple months before that deadline, and interested stakeholders have only a thirty-day window to submit comments about the proposed rule. Because the CSB is rushing to beat the district court&#8217;s deadline, we do not anticipate the CSB will grant any requests for an extension of that comment period.\u00a0 Accordingly, <strong>comments should be submitted to CSB by January 13, 2020.<\/strong><\/p>\n<p>If you have questions about the potential impact of the CSB&#8217;s new proposed accidental release reporting rule, contact <a href=\"http:\/\/www.connmaciel.com\/conn\" target=\"_blank\" rel=\"noopener\">Eric J.
