{"id":1901,"date":"2021-12-23T12:45:26","date_gmt":"2021-12-23T17:45:26","guid":{"rendered":"https:\/\/mshadefensereport.com\/?p=1901"},"modified":"2026-03-06T17:33:44","modified_gmt":"2026-03-06T17:33:44","slug":"oshas-vaccinate-or-test-ets-in-the-hands-of-the-supreme-court","status":"publish","type":"post","link":"https:\/\/www.connmaciel.com\/msha-defense-report\/oshas-vaccinate-or-test-ets-in-the-hands-of-the-supreme-court\/","title":{"rendered":"OSHA\u2019s Vaccinate-or-Test ETS in the Hands of the Supreme Court"},"content":{"rendered":"<p><em><strong>By Conn Maciel Carey LLP\u2019s\u00a0<a href=\"http:\/\/www.connmaciel.com\/covid-19-taskforce\" target=\"_blank\" rel=\"noopener\">COVID-19 Task Force<\/a><\/strong><\/em><\/p>\n<p>As we shared over the weekend, at 6:50 PM on Friday night (December 17<sup>th<\/sup>), a three-judge panel at the US Court of Appeals for\u00a0<a href=\"https:\/\/mshadefensereport.com\/2021\/12\/20\/breaking-sixth-circuit-rescinds-stay-of-oshas-vaccinate-or-test-emergency-temporary-standard\/\" target=\"_blank\" rel=\"noopener\">the Sixth Circuit dissolved the nationwide stay of OSHA\u2019s Vaccinate-or-Test ETS<\/a>\u00a0that had been issued in early November by the Fifth Circuit.\u00a0 That same night, several of the petitioners in the legal challenges to the ETS appealed the Sixth Circuit\u2019s decision to the Supreme Court.<\/p>\n<p>As we have been discussing for a while, the decision about the Stay of the ETS (and ultimately the legality of the ETS) was destined for the Supreme Court, and the Court, at least on the issue of the TRO\/Stay, could choose to address the question either by:<\/p>\n<ul>\n<li>the so-called \u201cshadow docket,\u201d with no briefing and a decision perhaps issued by a single Justice; or<\/li>\n<li>more conventional proceedings, with briefing and oral argument, and likely a decision by all nine Justices.<\/li>\n<\/ul>\n<p>Each of the nine Justices on the US Supreme Court is assigned to oversee one or more of the regional US courts of appeals. \u00a0Justice Kavanaugh is the justice assigned to the Sixth Circuit, to oversee requests for emergency review or shadow docket consideration from cases before the Sixth Circuit.\u00a0 Justice Kavanaugh is part of what is becoming something of a triad of swing voters on the Court, along with justice Coney Barrett and Chief justice Roberts.<\/p>\n<p>On Monday, Justice\u00a0<strong>Kavanaugh issued an Order to the Department of Labor to submit briefing in response to the emergency petitions with a deadline of 4 PM on Thursday, December 30<sup>th<\/sup><\/strong>.\u00a0 The Order does not provide for any additional briefing by petitioners or friends of the court. \u00a0Then, just a few hours ago, the Court issued\u00a0<strong>another Order setting the case for oral argument a week later, on January 7, 2022<\/strong>.<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2021\/12\/Capture-3.png?ssl=1\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-5530 aligncenter jetpack-lazy-image jetpack-lazy-image--handled\" src=\"https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2021\/12\/Capture-3.png?resize=529%2C323&amp;ssl=1\" sizes=\"(max-width: 529px) 100vw, 529px\" srcset=\"https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2021\/12\/Capture-3.png?resize=300%2C183&amp;ssl=1 300w, https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2021\/12\/Capture-3.png?resize=360%2C220&amp;ssl=1 360w, https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2021\/12\/Capture-3.png?w=581&amp;ssl=1 581w\" alt=\"\" width=\"529\" height=\"323\" data-attachment-id=\"5530\" data-permalink=\"https:\/\/oshadefensereport.com\/2021\/12\/23\/oshas-vaccinate-or-test-ets-in-the-hands-of-the-supreme-court\/capture-79\/#main\" data-orig-file=\"https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2021\/12\/Capture-3.png?fit=581%2C355&amp;ssl=1\" data-orig-size=\"581,355\" data-comments-opened=\"1\" data-image-meta=\"{&quot;aperture&quot;:&quot;0&quot;,&quot;credit&quot;:&quot;&quot;,&quot;camera&quot;:&quot;&quot;,&quot;caption&quot;:&quot;&quot;,&quot;created_timestamp&quot;:&quot;0&quot;,&quot;copyright&quot;:&quot;&quot;,&quot;focal_length&quot;:&quot;0&quot;,&quot;iso&quot;:&quot;0&quot;,&quot;shutter_speed&quot;:&quot;0&quot;,&quot;title&quot;:&quot;&quot;,&quot;orientation&quot;:&quot;0&quot;}\" data-image-title=\"Capture\" data-image-description=\"\" data-image-caption=\"\" data-medium-file=\"https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2021\/12\/Capture-3.png?fit=300%2C183&amp;ssl=1\" data-large-file=\"https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2021\/12\/Capture-3.png?fit=581%2C355&amp;ssl=1\" data-recalc-dims=\"1\" data-lazy-loaded=\"1\" \/><\/a><\/p>\n<p>We now have a clearer picture of <!--more--><span id=\"more-5527\"><\/span>how and approximately when the Supreme Court will determine the fate of OSHA\u2019s ETS (at least its fate while the Sixth Circuit considers the full merits of the legal challenges).<\/p>\n<p>First, we know there will NOT be a very quick shadow docket decision from the Supreme Court.\u00a0 Justice Kavanaugh was apparently not sitting and eagerly waiting for a chance to shut down a piece of President Biden\u2018s agenda. More importantly, it means we the Supreme Court is not going to take action in time to help employers avoid the heavy lifting to come into compliance with the ETS.\u00a0 Indeed, we know now that we will not have a decision this year, and since the applications for stay are \u201cdeferred pending [the Friday, January 7<sup>th<\/sup>] oral argument,\u201d we will not even have a decision before the week of January 10, 2022.\u00a0 That is significant since the ETS is officially in effect right now, and for employers making reasonable good faith efforts to come into compliance, the new deadline for most of the elements of the ETS was moved by OSHA to January 10, 2022.<\/p>\n<p>Second, we also know that unlike other very quick shadow docket decisions, where there is typically no additional briefing beyond the Court of Appeals level, the Supreme Court in this case is going to see a brief from the Department of Labor and hear oral argument from petitioners and the Department.<\/p>\n<p>Finally, we also know that unlike the quick shadow docket decisions we have scene recently, which typically appear as decisions by a single Justice, it appears that Justice Kavanaugh here has \u201creferred to the Court\u201d these applications; i.e., all nine Justices will be involved in the consideration of the Stay.<\/p>\n<p>These three differences in process could be meaningful.\u00a0 That is, it could be a sign that the Supreme Court views this federal vaccination rule as something different from the other vaccine-mandates that have recently come before the Court and quickly resolved by the shadow docket.\u00a0 For example, yesterday, the Court permitted a governmental vaccine-mandate remain in effect in the face of a legal challenge.\u00a0 This time it was a challenge by nurses to the State of New Mexico\u2019s healthcare vaccine-mandate, and the Court ruled quickly by way of the shadow docket, with Justice Gorsuch issuing a simple order, on his own, declining to stop the State\u2019s implementation and enforcement of the mandate.\u00a0 For those keeping score at home, that increases the record to 6-0 of the Supreme Court siding with COVID-19 vaccine requirements.\u00a0 Four of them state issued and two imposed by private employers.\u00a0 All six of them decided via the shadow docket, without briefing or oral argument, and by opinion of a single Justice.\u00a0 However, this would be the first challenges to\u00a0<em>the federal government\u2019s<\/em>\u00a0authority to set vaccination requirements, and it is being handled by the Supreme Court by a different process.<\/p>\n<p>It is also notable that the Court has set oral argument on the same day for the challenges related to President Biden\u2019s CMS healthcare vaccine mandate, which is currently stayed in half the states in the country.<a href=\"https:\/\/oshadefensereport.com\/2021\/12\/21\/faqs-about-oshas-covid-19-vaccination-testing-and-face-coverings-emergency-temporary-standard\/\" target=\"_blank\" rel=\"noopener\"><img \/><\/a><\/p>\n<p>In short, do not expect a Stay of the ETS as a Christmas gift from the Supreme Court, look out for a decision from the full Supreme Court about the status of OSHA ETS and the CMS healthcare worker vaccine-mandate likely during the week of January 10<sup>th<\/sup>, and accordingly either continue or begin to take steps to come into compliance with OSHA\u2019s vaccinate-or-test
