Temporarily Stays OSHA\u2019s COVID-19 Vaccination, Testing, and Face Coverings Emergency Rule"},"content":{"rendered":"<p><em><strong>By Conn Maciel Carey\u2019s\u00a0<a href=\"http:\/\/www.connmaciel.com\/covid-19-taskforce\" target=\"_blank\" rel=\"noopener\">COVID-19 Task Force<\/a><\/strong><\/em><\/p>\n<p>On Saturday, November 6th, a three-judge panel of the US Court of Appeals for the\u00a0<a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2021\/11\/5th-Circuit-Order.2021.11.06.pdf\" target=\"_blank\" rel=\"noopener\">Fifth Circuit issued a Temporary Restraining Order (TRO) staying the effect of OSHA\u2019s vaccination, testing, and face coverings emergency temporary standard (ETS)<\/a>\u00a0that it had promulgated just the day before.\u00a0 The entirety of the court\u2019s explanation for the stay Order was this:<\/p>\n<blockquote><p><em>\u201cBecause the petitions give cause to believe there are grave statutory<\/em><br \/>\n<em>and constitutional issues with the Mandate, the Mandate is hereby STAYED<\/em><br \/>\n<em>pending further action by this court.\u201d<\/em><\/p><\/blockquote>\n<p>The suit challenging\u00a0<a href=\"https:\/\/oshadefensereport.com\/2021\/11\/04\/osha-issues-its-covid-19-vaccination-testing-and-face-coverings-emergency-temporary-standard\/\" target=\"_blank\" rel=\"noopener\">OSHA\u2019s new vaccination, testing, and face coverings ETS<\/a>\u00a0was initiated on behalf of a group of private businesses and religious organizations, as well as several states, including Texas, Louisiana, South Carolina, Utah and Mississippi. The petitioners argued that OSHA overstepped its legal authority in issuing an emergency standard to address COVID-19 in US workplaces at this point in the pandemic.<a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2021\/11\/5th-Circuit-Order.2021.11.06.pdf\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright The petitioners assert that an emergency stay is necessary because these employers will face workforce shortages if unvaccinated employees quit their jobs in lieu of receiving a COVID-19 vaccination, and the ETSforces them to expend resources to develop and implement written compliance and reporting procedures beyond what the law authorizes under the circumstances.<\/p>\n<p>Specifically, their objections to the OSHA ETS include:<!--more--><span id=\"more-5337\"><\/span><\/p>\n<ul>\n<li>OSHA\u2019s authority to issue an emergency standard is limited to workplace-related hazards, but the risk of COVID-19 infection is a \u201csociety-wide danger.\u201d<\/li>\n<li>OSHA cannot show that COVID-19 is a grave danger now for all employers with 100 or more employees because just a few months ago OSHA concluded that COVID-19 was\u00a0<u>only<\/u>\u00a0a \u201cgrave danger\u201d to healthcare employees.<\/li>\n<li>COVID is not a \u201cgrave danger\u201d to all workers \u2013 the risk depends on individual employees\u2019 age and health, not how many co-workers they have.<\/li>\n<li>OSHA ETS is not sufficiently \u201cnarrowly tailored\u201d because the mandate applies regardless of individual employee\u2019s personal risks and differences in workplace conditions.<\/li>\n<li>OSHA\u2019s emergency authority is limited to\u00a0\u201cnew hazards\u201d from \u201csubstances or agents determined to be toxic or physically harmful\u201d which cannot be stretched so far to cover the spread of any communicable disease.<\/li>\n<\/ul>\n<p>The\u00a0<a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2021\/11\/5th-Circuit-Order.2021.11.06.pdf\" target=\"_blank\" rel=\"noopener\">5<sup>th<\/sup>\u00a0Circuit\u2019s two-page opinion<\/a>\u00a0holds that petitioners met their burden in demonstrating that the Administration\u2019s issuance of the ETS poses grave statutory and constitutional issues, and, therefore a stay is appropriate.\u00a0 Further consideration of the issue will be given based on the briefings filed over the next several days by the parties.<\/p>\n<p>This 5th Circuit decision follows the filing of four separate lawsuits in the 8th Circuit, 11th Circuit, 6th Circuit, and 5th Circuit in the last several days challenging the Administration\u2019s vaccine mandates.\u00a0 The lawsuit that was filed late in the week by the 8th Circuit was initiated by Missouri Alaska, Arizona, Arkansas, Montana, Nebraska, New Hampshire, North Dakota, South Dakota and Wyoming and Iowa.<\/p>\n<p>The 5th Circuit\u2019s Order to stay the OSHA ETS is the first court to stop implementation of any vaccination-related mandate by the federal government or a state government during the pandemic.\u00a0 The panel of judges that issued that Order was composed of one Reagan-appointee and two judges appointed by former President Trump.<\/p>\n<p>The Department of Labor\u2019s response to the stay Order and the issue of whether this temporary stay should become a permanent injunction of OSHA\u2019s ETS indefinitely is due to be filed with the court on Monday at 5pm, with the petitioners\u2019 reply due by 5pm on Tuesday. Presumably a hearing will be set imminently and a prompt decision in the case is likely to be made soon after in what are clearly very expedited proceedings.<\/p>\n<p>There is no guarantee the stay of the ETS remains in place after that, and whether higher courts will need to get involved, including the Supreme Court.
