{"id":2004,"date":"2017-02-20T13:45:32","date_gmt":"2017-02-20T18:45:32","guid":{"rendered":"http:\/\/employerdefensereport.com\/?p=2004"},"modified":"2026-03-12T16:09:00","modified_gmt":"2026-03-12T20:09:00","slug":"trump-taps-alex-acosta-for-new-department-of-labor-secretary","status":"publish","type":"post","link":"https:\/\/www.connmaciel.com\/employer-defense-report\/trump-taps-alex-acosta-for-new-department-of-labor-secretary\/","title":{"rendered":"Trump Taps Alex Acosta for New Department of Labor Secretary"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"  wp-image-231 alignleft\" src=\"http:\/\/employerdefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/2\/2015\/12\/department-of-labor.jpg\" alt=\"Department of Labor\" width=\"220\" height=\"220\" srcset=\"https:\/\/www.connmaciel.com\/employer-defense-report\/wp-content\/uploads\/sites\/2\/2015\/12\/department-of-labor.jpg 225w, https:\/\/www.connmaciel.com\/employer-defense-report\/wp-content\/uploads\/sites\/2\/2015\/12\/department-of-labor-150x150.jpg 150w, https:\/\/www.connmaciel.com\/employer-defense-report\/wp-content\/uploads\/sites\/2\/2015\/12\/department-of-labor-167x167.jpg 167w\" sizes=\"(max-width: 220px) 100vw, 220px\" \/>As readers of this\u00a0<a href=\"https:\/\/employerdefensereport.com\/2016\/12\/14\/trump-picks-fast-food-restaurant-ceo-andrew-puzder-as-labor-secretary-seismic-shift-is-anticipated-in-agencys-rulemaking-and-enforcement\/\">blog<\/a>\u00a0are aware, President Trump originally chose Andrew Puzder, the CEO of CKE Holdings, the parent company of Carl\u2019s Jr. and Hardee\u2019s, as his Secretary of Labor.\u00a0 However, on February 15, 2017, one day prior to his confirmation hearing, Mr. Puzder withdrew his name from consideration amidst reports that he would not receive the required Senate votes necessary for confirmation based in part on allegations that he failed to pay workers overtime pay, condoned sexual harassment, and opposed legislative efforts to address those problems.\u00a0 The next day, President Trump officially tapped former U.S. Attorney Alex Acosta for the position. \u00a0As Labor Secretary, Acosta will oversee the federal apparatus that investigates violations of minimum wage, overtime and workplace safety laws and regulations.<\/p>\n<p>If confirmed, Acosta would be the first Hispanic member of President Trump\u2019s cabinet.\u00a0 Mr. Acosta has a strong background in public service.\u00a0 After graduating from Harvard Law School, he clerked for Judge (now Supreme Court Justice) Samuel Alito on the Third Circuit Court of Appeals. \u00a0He has also served as a member of the National Labor Relations Board, head of the U.S. Department of Justice\u2019s Civil Rights Division (both of which he was appointed to by President George W. Bush), and U.S. Attorney for the Southern District of Florida.\u00a0 Most recently, Acosta served as Dean of the Florida International University School of Law.\u00a0 Should he be confirmed, Acosta\u2019s public and private experiences (he also practiced law at Kirkland &amp; Ellis) should enable him to take into account numerous perspectives in his new role.<\/p>\n<p>At this stage, Acosta\u2019s views on various pressing issues at the Department of Labor &#8212; such as<!--more--> consideration of a higher minimum wage or the\u00a0<a href=\"https:\/\/employerdefensereport.com\/2016\/11\/23\/district-court-judge-grants-injunction-putting-dol-overtime-rule-on-hold\/\">proposed new overtime regulations that currently are on hold<\/a>\u00a0&#8212; are largely unknown. \u00a0Nonetheless, while Puzder was harshly criticized for his anti-regulatory positions (he was\u00a0a vocal critic of the Obama Labor Department\u2019s overtime regulations and efforts to increase the federal minimum wage) and numerous other controversies relating to his personal life, Acosta has so far avoided such controversy.\u00a0 Moreover, Acosta has already been vetted by the Senate multiple times for the positions he held during the Bush administration.\u00a0 For those reasons, as well as Acosta\u2019s combination of academic and practical legal experience, it is expected that his confirmation process will not suffer the same fate that ultimately forced Puzder to withdraw.<\/p>\n<p>The immediate reaction to the announcement of Acosta\u2019s nomination was in stark contrast to how many viewed Puzder and lends further credence to the belief that his nomination will be accepted.\u00a0 Notably, AFL-CIO President Richard Trumka responded to the news of Acosta\u2019s nomination by stating:<\/p>\n<blockquote><p>\u201cWorking people changed the game on this nomination.\u00a0 Unlike Andy Puzder, Alexander Acosta\u2019s nomination deserves serious consideration. \u00a0In one day, we\u2019ve gone from a fast-food CEO who routinely violates labor law to a public servant with experience enforcing it.\u201d<\/p><\/blockquote>\n<p>This reaction by labor unions to Acosta\u2019s nomination may be partly attributable to the belief that he is more of a \u201cmainstream\u201d nominee and more predictable than Puzder, which may provide at least some comfort to employers.\u00a0 At the same time, most pundits believe that Acosta has the unique ability to take both employer and employee points of view into account when making decisions, which makes him particularly qualified for this position.<\/p>\n<p>Ultimately, it is likely that, as would have been the case under Puzder, employers may benefit from Acosta&#8217;s authority to reallocate agency resources away from agency enforcement actions for labor law violations. Under Obama, the Wage and Hour Division had been very active in enforcing labor laws and investigating industries and workplaces with a history of labor law violations.
