{"id":1458,"date":"2016-10-27T16:10:51","date_gmt":"2016-10-27T20:10:51","guid":{"rendered":"http:\/\/employerdefensereport.com\/?p=1458"},"modified":"2026-03-20T11:42:20","modified_gmt":"2026-03-20T15:42:20","slug":"fair-pay-and-safe-workplaces-rule-temporarily-put-on-hold","status":"publish","type":"post","link":"https:\/\/www.connmaciel.com\/employer-defense-report\/fair-pay-and-safe-workplaces-rule-temporarily-put-on-hold\/","title":{"rendered":"Fair Pay and Safe Workplaces Rule Temporarily Put on Hold"},"content":{"rendered":"<p>Following\u00a0<a href=\"https:\/\/www.whitehouse.gov\/the-press-office\/2014\/07\/31\/executive-order-fair-pay-and-safe-workplaces\">President Obama\u2019s 2014 \u201cFair Pay and Safe Workplaces\u201d Executive Order (EO 13673)<\/a>\u00a0\u2014 in August the Federal Acquisition Regulatory (FAR) Council in conjunction with the Department of Labor (DOL) issued its controversial\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2016\/08\/25\/2016-19676\/federal-acquisition-regulation-fair-pay-and-safe-workplaces\">Fair Pay and Safe Workplaces rule<\/a>, which was scheduled to take effect on October 25, 2016.\u00a0\u00a0Among other things, this rule, commonly referred to by opponents as the \u201cblacklisting\u201d rule, requires potential federal contractors and subcontractors bidding on any deal worth more than $500,000 (with several exceptions) to disclose violations of labor law, going back three years.\u00a0 Contracting officers would be required to take those disclosures into account in their decisions as to whether to award or extend contracts, based on whether they showed \u201cserious, repeated, willful or pervasive\u201d labor law violations. \u00a0Our OSHA group previously blogged about this rule when it was in its proposed stages. Although the final rule does contain some important changes from the proposed rule, such as a phased-in reporting requirement and unique subcontractor reporting obligations, you can check out that <a href=\"https:\/\/oshadefensereport.com\/2015\/09\/15\/osha-rule-in-far-clothing-the-government-contractor-blacklisting-rule\/\">blog post<\/a> for insight on the potential impact of this Rule from an OSHA perspective.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" title=\"Blacklisting\" class=\"  wp-image-1499 alignright\" src=\"http:\/\/employerdefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/2\/2016\/10\/blacklisting.jpg\" alt=\"blacklisting\" width=\"341\" height=\"211\" \/><\/p>\n<p>On October 7, 2016, several trade groups (including Associated Builders and Contractors Inc. and the National Association of Security Companies) filed a lawsuit requesting a Temporary Restraining Order and Preliminary Injunction in which they sought to enjoin the implementation of EO 13673,\u00a0the FAR regulations, and corresponding guidance from the DOL.\u00a0 In the lawsuit, the plaintiffs argued that the rule would violate contractors\u2019 First Amendment and due process rights and harm fair and open competition for federal contracts in the marketplace by forcing bidders to disclose allegations of labor law violations that were not yet fully adjudicated.\u00a0 The suit also argued that the rule constituted an unprecedented overreach of executive authority into matters previously controlled by Congress.<\/p>\n<p><!--more--><\/p>\n<p>On October 24, U.S. District Judge Marcia Crone of the United States District Court for the Eastern District of Texas accepted the arguments set forth by the plaintiffs and granted a nationwide\u00a0<a href=\"http:\/\/1yxsm73j7aop3quc9y5ifaw3.wpengine.netdna-cdn.com\/wp-content\/uploads\/2016\/10\/NASCO-Order-granting-PI.pdf\" target=\"_blank\">preliminary injunction<\/a>.\u00a0 In so doing, she blocked the \u201cblacklisting\u201d portion of the rule from taking effect.\u00a0 Specifically, Judge Crone agreed with the trade groups\u2019 argument that the disclosure requirement was unconstitutional, holding that that the executive branch exceeded its authority and violated the free speech and due process rights of federal contractors by compelling them to report and defend against non-final agency allegations of labor law violations without being entitled to a hearing at which to contest such allegations.\u00a0 In her decision, Judge Crone noted the groups that initiated the lawsuit had \u201cproperly demonstrated immediate and ongoing injury to their members\u201d if the rule was allowed to take effect. \u00a0Judge Crone also found that contractors would face significant burdens in implementing the compliance scheme necessary to comply with the rule as proposed.<\/p>\n<p>Although this is a significant victory for government contractors, this victory may prove to be only temporary. \u00a0Thus, employers need to proceed with caution. \u00a0First, the injunction does not affect the rule\u2019s pay transparency provision, which requires federal contractors to provide wage statements and information to workers regarding their hours worked, overtime hours, pay, and any additions or deductions to their pay starting on January 1, 2017.<\/p>\n<p>Second, although the granting of a preliminary injunction means that the court deems a plaintiff\u2019s case to have a \u201csubstantial likelihood of success on the merits,\u201d there is certainly no guarantee this &#8220;blacklisting&#8221;
