DiSalvo<\/strong><\/a>\u00a0and\u00a0<a href=\"http:\/\/www.connmaciel.com\/beeta-b-lashkari\" target=\"_blank\" rel=\"noopener\"><strong>Beeta B. Lashkari<\/strong><\/a><\/p>\n<p>When OSHA receives a complaint related to worker safety and health or a severe injury report, one action by OSHA is to give the employer an opportunity to respond before it takes the more extreme action of opening an inspection.\u00a0 In addition, when OSHA receives an allegation of retaliation, it must provide the employer a chance to explain why the adverse employment action of which it is accused was legitimate or did not occur as alleged.\u00a0 These responses are an opportunity for the employer to avoid an inspection or litigation of a retaliation claim.\u00a0\u00a0A strong response could assuage OSHA\u2019s concerns and resolve the complaint in a favorable manner for the employer.\u00a0 However, these responses can also create a written record of admissions to which OSHA can hold the employer accountable, and any supporting documentation may be closely scrutinized and used to create liability.<\/p>\n<p>Thus, employers must\u00a0ensure there is a procedure in place for managing and developing the responses to these situations, and\u00a0be strategic about the information they share with OSHA in the response.\u00a0 We are pleased to share the following tips and strategies for how to effectively address such complaints.<\/p>\n<p><strong><u>Whistleblower Complaints<a href=\"https:\/\/www.osha.gov\/laws-regs\/oshact\/section_11\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1928 jetpack-lazy-image jetpack-lazy-image--handled\" src=\"https:\/\/i1.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2019\/07\/sec-11c.png?resize=426%2C291&amp;ssl=1\" alt=\"\" width=\"426\" height=\"291\" \/><\/a><\/u><\/strong><\/p>\n<p>To start, although OSHA enforces whistleblower standards under 22 different statutes, the agency receives most of its retaliation claims (over 62%) under\u00a0<strong><a href=\"https:\/\/www.osha.gov\/laws-regs\/oshact\/section_11\" target=\"_blank\" rel=\"noopener\">Section 11(c) of the Occupational Safety and Health (OSH) Act<\/a><\/strong>. Section 11(c) prohibits employers from retaliating against workers who in good faith attempt to exercise a worker safety-related protected right under the law.<\/p>\n<p>While the vast majority \u2013 about 71% \u2013 are either dismissed by OSHA or withdrawn by the employee, the sheer number of complaints OSHA receives, and the fact that nearly 30% of them do end in favor of the employee, should be more than motivation for employers to thoroughly address each one filed against them.\u00a0 This is particularly true because, under Section 11(c), employees can be entitled to substantial remedies, such as\u00a0<span id=\"more-1918\"><\/span>reinstatement, back pay, front pay, compensatory damages, and punitive damages if the employee can show \u201cevil motive or callous indifference\u201d on the part of the employer.<\/p>\n<p>Understanding the elements of the employee\u2019s case, and how to defend against them, therefore, is essential.\u00a0 Prior to 2016, the employee had to establish a\u00a0<em>prima facie<\/em>\u00a0case of retaliation in order to maintain a claim and proceed through an OSHA investigation.\u00a0 Now, however,\u00a0<a href=\"https:\/\/www.osha.gov\/OshDoc\/Directive_pdf\/CPL_02-03-007.pdf\" target=\"_blank\" rel=\"noopener\"><strong>OSHA guidance in its Whistleblower Manual<\/strong><\/a>\u00a0states that an employee need only prove its claim has merit.\u00a0 As such, the bar for employees is much lower, and a complaint can go forward even if there is only reasonable cause to believe a violation occurred.<a href=\"https:\/\/www.osha.gov\/OshDoc\/Directive_pdf\/CPL_02-03-007.pdfhttp:\/\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1929 jetpack-lazy-image jetpack-lazy-image--handled\" src=\"https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2019\/07\/whistleblower-manual.png?resize=342%2C355&amp;ssl=1\" alt=\"\" width=\"342\" height=\"355\" \/><\/a><\/p>\n<p>Nonetheless, the elements of a whistleblower claim under Section 11(c) are similar to the elements under other types of retaliation claims.\u00a0 The employee must prove that:<\/p>\n<ol>\n<li>s\/he engaged in protected activity;<\/li>\n<li>the employer took some adverse action; and<\/li>\n<li>there was a causal connection between the protected activity and adverse action.<\/li>\n<li>Additionally, and unlike other types of retaliation claims, the employee must also prove knowledge; i.e., that the decisionmaker knew of the protected activity at the time of taking the adverse action.<\/li>\n<\/ol>\n<p>If the employee can show the required elements, the employer then has the opportunity to counter them by demonstrating it had a legitimate, non-discriminatory reason for the adverse action.\u00a0 The reason may be insubordination or poor performance, among a host of other reasons.<\/p>\n<p>It is important for employers to understand the elements an employee must establish and its own potential defenses because these are the topics an employer should address in its position statement to OSHA.\u00a0 Essentially, this is the employer\u2019s first and best chance to submit a persuasive written response to the allegations in the complaint, so drafting this statement is the opportune time to seek assistance from experienced legal counsel.<\/p>\n<p>Here are some of our best practice tips:<\/p>\n<ul>\n<li>Investigate the complaint promptly and document your findings.\n<ul>\n<li>\n<ul>\n<li>Determine if the complaint was timely<\/li>\n<li>Collect relevant documents to support your position<\/li>\n<li>Interview employees with any knowledge of the claim, etc.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li>Draft an effective position statement.\n<ul>\n<li>\n<ul>\n<li>The position statement should give context to the employee\u2019s allegations from the employer\u2019s perspective, and should be told in a way that is easy for the OSHA investor to follow.<\/li>\n<li>We recommend splitting the position statement into two parts: (i) factual background; and (ii) legal analysis.<\/li>\n<li>We also recommend providing supporting documentation, but caution that the documentation should not disclose potentially adverse or confidential information.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li>To avoid any potential for additional claims of retaliation, immediately after receiving notification of the complaint from OSHA, take steps to ensure no retaliatory actions are taken against the complaining employee; e.g., reminding managers that they should not take any action that could be perceived as retaliatory.<\/li>\n<\/ul>\n<p><strong><u>Health and Safety Complaints<\/u><\/strong><\/p>\n<p>Under\u00a0<strong><a href=\"https:\/\/www.osha.gov\/laws-regs\/oshact\/section_8\" target=\"_blank\" rel=\"noopener\">Section 8(f)(1) of the OSH Act<\/a><\/strong>, every employee is given the right to complain to OSHA and ask for an inspection when s\/he believes there has been a violation of a health and safety standard.\u00a0 OSHA, however, simply does not have the resources to conduct an inspection for each and every complaint it receives.\u00a0 Accordingly, it must decide whether the complaint merits an on-site inspection, or whether the agency will send out a Notice of Alleged Hazard(s) (also known as a \u201cPhone and Fax Complaint\u201d) to the employer.<\/p>\n<p>OSHA has a list of priority complaints that typically result in an on-site inspection.\u00a0\u00a0<a href=\"https:\/\/www.osha.gov\/as\/opa\/worker\/handling.html\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1930 jetpack-lazy-image jetpack-lazy-image--handled\" src=\"https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2019\/07\/noah.png?resize=392%2C401&amp;ssl=1\" alt=\"\" width=\"392\" height=\"401\" \/><\/a>These include:<\/p>\n<ul>\n<li>written, signed complaints by current employees that have enough detail to enable OSHA to determine that a violation or hazard likely exists that threatens physical harm;<\/li>\n<li>complaints that allege that a physical harm has occurred as a result of the hazard and that it still exists; and<\/li>\n<li>reports of imminent danger.<\/li>\n<\/ul>\n<p>If OSHA does initiate an on-site inspection, we recommend you check out Conn Maciel Carey\u2019s\u00a0<a href=\"http:\/\/docs.wixstatic.com\/ugd\/3a90ba_d025bd37755946109576d8cf8bc4f286.pdf\" target=\"_blank\" rel=\"noopener\"><strong>OSHA Inspection Toolkit<\/strong><\/a>\u00a0and contact experienced OSHA defense counsel for assistance.<\/p>\n<p>Where OSHA decides\u00a0<em>not<\/em>\u00a0to conduct an inspection, it will still send out a Notice of Alleged Hazard(s) to solicit additional information from the employer related to the complaint.\u00a0 This notice will convey the specific safety and\/or health complaint that OSHA received, and will request that the employer investigate and respond \u2014 either to rebut the truth of the allegation or to describe the corrective actions the employer has taken.\u00a0 An inadequate response to that Notice can trigger an on-site inspection, and can be used against the employer in that inspection and potential enforcement process.<\/p>\n<p>Accordingly, it is important to provide an effective and careful response.\u00a0 Here are some of our best practice tips for responding to Notices of Alleged Hazard(s):<\/p>\n<ul>\n<li>Conduct a prompt and thorough investigation.<\/li>\n<li>Make sure to document the investigation process, scope, and findings in your response to OSHA.<\/li>\n<li>Remember, this is not a subpoena response, so selectively share your information that presents an honest response, but one that casts your safety program in the best possible light.<\/li>\n<li>Demonstrate and document the absence of the alleged hazard, if the complaint is without merit.<\/li>\n<li>If the investigation identifies opportunities for improvement or the need for corrective action, immediately implement or plan the corrective actions and improvements, and inform OSHA of the corrective actions and improvements without admitting to regulatory deficiencies.<\/li>\n<li>Do not \u201cblame\u201d employees.<\/li>\n<li>Ask OSHA for a closeout report, and keep it in your file, along with your response and the original Notice.<\/li>\n<\/ul>\n<p><strong><u>Severe Injury Reports<\/u><\/strong><\/p>\n<p>In 2015, OSHA\u2019s\u00a0<strong><a href=\"https:\/\/www.osha.gov\/pls\/oshaweb\/owadisp.show_document?p_table=STANDARDS&amp;p_id=12783\" target=\"_blank\" rel=\"noopener\">new injury and fatality reporting rule<\/a><\/strong>\u00a0became effective, significantly revising the triggering events for reporting workplace accidents to OSHA under the Agency\u2019s\u00a0<a href=\"https:\/\/www.osha.gov\/pls\/oshaweb\/owadisp.show_document?p_table=STANDARDS&amp;p_id=12783\" target=\"_blank\" rel=\"noopener\"><strong>Injury and Illness Recordkeeping regulations at 29 C.F.R. 1910.104<\/strong><\/a>,<em>\u00a0et seq.\u00a0\u00a0<\/em>The new Severe Injury Reporting Rule lower the threshold for proactively reporting a catastrophic incident from the hospitalization of three or more employees to the\u00a0<a href=\"https:\/\/oshadefensereport.com\/2017\/10\/23\/reporting-in-patient-hospitalizations-to-osha-common-misunderstandings-and-mistakes\/\" target=\"_blank\" rel=\"noopener\"><strong>hospitalization of a single employee<\/strong><\/a>, and added\u00a0<a href=\"https:\/\/oshadefensereport.com\/2015\/12\/01\/slicing-the-nuances-of-oshas-amputation-reporting-requirements\/\" target=\"_blank\" rel=\"noopener\"><strong>amputations<\/strong><\/a>\u00a0(including partial amputations) and losses of an eye to the types of injuries that employers must proactively report.\u00a0 By lowering the threshold from three employees hospitalized to a single employee has dramatically increased the number of incidents that are not reported to OSHA, from at most 50 a year to tens of thousands today.<\/p>\n<p>Because OSHA has been flooded by reports of worker injuries, it became impossible for the agency to respond to each, or even a meaningful percentage of reports, with an on-site enforcement inspections.\u00a0 Accordingly, OSHA issued \u201c<a href=\"https:\/\/www.osha.gov\/dep\/enforcement\/Interm_Enforcement_Procedures.html\" target=\"_blank\" rel=\"noopener\"><strong>Enforcement Procedures for [OSHA\u2019s] New Reporting Requirements<\/strong><\/a>,\u201d which advises its field offices when to conduct on-site inspections, or conversely, when to not inspect, and instead to utilize its new\u00a0<strong><a href=\"https:\/\/www.osha.gov\/dep\/enforcement\/Interm_Enforcement_Procedures.html\" target=\"_blank\" rel=\"noopener\">\u201cRapid Response Investigation\u201d (RRI) protocol<\/a><\/strong>.<\/p>\n<p>According to its Enforcement Procedures, OSHA categorizes injury reports into one of three buckets to help make its decision.\u00a0 Category 1 reports are supposed to always result in an onsite inspection.\u00a0 These include:<\/p>\n<ol>\n<li>incidents resulting in a fatality;<\/li>\n<li>hospitalizations of 2+ employees;<\/li>\n<li>injuries to youth employees;<\/li>\n<li>incidents involving an employer with a known history of injuries, past Repeat or Willful violations, or an SVEP employer; and<\/li>\n<li>incidents related to an active\u00a0<strong><a href=\"https:\/\/www.osha.gov\/enforcement\/directives\/nep\" target=\"_blank\" rel=\"noopener\">National or Local enforcement emphasis program<\/a><\/strong><\/li>\n<\/ol>\n<p>Category 2 reports may result in an on-site inspection or RRI, based on the discretion of the OSHA Area Director after s\/he evaluates a variety of factors, including whether:<\/p>\n<ol>\n<li>employee was exposed to a very serious hazard;<\/li>\n<li>hazardous conditions have already been corrected;<\/li>\n<li>the incident resulted from a systemic failure;<\/li>\n<li>temporary workers were involved;<\/li>\n<li>another governmental agency made a referral; or<\/li>\n<li>the incident involved chemical exposures, heat stress, or other health (vs. safety) issues.<\/li>\n<\/ol>\n<p>Category 3 \u2014 everything else \u2014 always result in RRIs.<a href=\"https:\/\/www.osha.gov\/dep\/enforcement\/Interm_Enforcement_Procedures.html\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-98 jetpack-lazy-image jetpack-lazy-image--handled\" src=\"https:\/\/i2.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2015\/09\/reporting-2-jpg.png?resize=474%2C384&amp;ssl=1\" alt=\"Reporting 2.JPG\" width=\"474\" height=\"384\" \/><\/a><\/p>\n<p>The RRI letter is an investigative tool that OSHA uses to help OSHA understand the root cause of the incident and what the employer has done to correct it.\u00a0 Under the RRI program, the employer will receive an RRI request letter, which directs the employer to conduct an accident investigation, document the findings and corrective actions, post a copy of this letter where employees can review it, and submit the findings and corrective actions to OSHA.<\/p>\n<p>Importantly, if you do not respond, then OSHA will open an on-site inspection.\u00a0 Likewise, if OSHA finds your response inadequate, it will also open an on-site inspection.\u00a0 Accordingly, it is critical to respond to these requests and to do so carefully; i.e., provide enough and the right information to dissuage OSHA from opening an inspectiong, but not to make admissions that can be used against you in an inspection or enforcement proceeding.<\/p>\n<p>Here are some of our suggestions for how best to respond to an RRI request:<\/p>\n<ul>\n<li>Conduct a thorough investigation. Review applicable documents, talk to injured workers and witnesses, etc.<\/li>\n<li>Be strategic about what and how information is provided in your response.\u00a0 Be careful not to document an admission.<\/li>\n<li>For an RRI letter, use OSHA\u2019s \u201cnon-mandatory\u201d investigation form, which makes it easier for OSHA to \u201ccheck the box\u201d that all information it needs to close the file has been provided.<\/li>\n<li>Do not list \u201cemployee misconduct\u201d as the first or sole cause of an injury, if at all possible, but include it, if applicable, to preserve that defense.<\/li>\n<li>Include at least one corrective action in your response.\u00a0 Whether this is a correction or improvement, it shows the agency that you are taking the issue seriously.<\/li>\n<\/ul>\n<hr \/>\n<p>For much more information about all of this, check out Conn Maciel Carey\u2019s April 2019 webinar: \u201c<strong><a href=\"https:\/\/youtu.be\/VGKoiR3CteA\" target=\"_blank\" rel=\"noopener\">Guide to Responding to 11(c) Safety Retaliation Complaints and Notices of Alleged Hazards \/ Employee Safety Complaints<\/a><\/strong>.\u201d\u00a0<a href=\"https:\/\/youtu.be\/VGKoiR3CteA\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1841 jetpack-lazy-image jetpack-lazy-image--handled\" src=\"https:\/\/i1.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2019\/04\/thumbnail-1.png?resize=403%2C303&amp;ssl=1\" alt=\"thumbnail-1\" width=\"403\" height=\"303\" \/><\/a>\u00a0Participants in\u00a0<a href=\"https:\/\/youtu.be\/VGKoiR3CteA\" target=\"_blank\" rel=\"noopener\"><strong>that webinar<\/strong><\/a>\u00a0learned about the following:\u200b<span id=\"more-1839\"><\/span><\/p>\n<ul>\n<li>The types of complaints and incidents that lead OSHA to request information from the employer;<\/li>\n<li>Specific prohibitions of Section 11(c) (OSHA\u2019s anti-retaliation law) and how retaliation complaints are evaluated;<\/li>\n<li>Strategies employers can use to effectively respond to Section 11(c) complaints, Notices of Alleged Hazards, and RRI requests;
