Employers to Submit 2017 Injury Data by Year End"},"content":{"rendered":"<p>By\u00a0<a href=\"http:\/\/www.connmaciel.com\/sommer\" target=\"_blank\" rel=\"noopener\">Andrew Sommer<\/a>,\u00a0<a href=\"http:\/\/www.connmaciel.com\/megan-s-shaked\" target=\"_blank\" rel=\"noopener\">Megan Shaked<\/a>, and\u00a0<a href=\"http:\/\/www.connmaciel.com\/deacon\" target=\"_blank\" rel=\"noopener\">Dan Deacon<\/a><\/p>\n<p>As we have reviewed previously on the\u00a0<a href=\"https:\/\/oshadefensereport.com\/?s=E-Recordkeeping\" target=\"_blank\" rel=\"noopener\">OSHA Defense Report<\/a>, federal OSHA\u2019s Rule to \u201c<a href=\"https:\/\/s3.amazonaws.com\/public-inspection.federalregister.gov\/2016-10443.pdf\" target=\"_blank\" rel=\"noopener\">Improve Tracking of Workplace Injuries and Illnesses<\/a>\u201d (aka the E-Recordkeeping Rule) requires small employers that operate in certain \u201chigh hazard industries\u201d and all large employers to proactively submit their electronic injury and illness data to OSHA through a web portal \u2013 the\u00a0<a href=\"https:\/\/www.osha.gov\/injuryreporting\/\" target=\"_blank\" rel=\"noopener\">Injury Tracking Application<\/a>\u00a0(\u201cITA\u201d).<\/p>\n<p>When federal OSHA promulgated the Rule in 2016,\u00a0<a href=\"https:\/\/www.osha.gov\/recordkeeping\/finalrule\/index.html\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1731 jetpack-lazy-image jetpack-lazy-image--handled\" src=\"https:\/\/i0.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2018\/12\/E-Recordkeeping-Rule-2.png?resize=416%2C393&amp;ssl=1\" alt=\"E-Recordkeeping Rule\" width=\"355\" height=\"336\" \/><\/a>it built into the Rule a mandate that all State Plans adopt substantially identical requirements within six months after its publication.\u00a0 Implementation of the federal Rule, however, has been mired in difficulty from industry challenges, shifting guidance, informal changes, extended deadlines and mixed signals about the future of the rule as we transitioned from the Obama administration to the Trump administration.\u00a0 As a result, numerous State OSH programs failed to initially adopt the rule.\u00a0 After some headbutting with federal OSHA, almost all of the delinquent states, including California, have now implemented rules to \u201ccatch-up\u201d to the federal OSHA data submission rule.<\/p>\n<p><strong><u>Delinquent State Plans Began Adopting E-Recordkeeping<\/u><\/strong><\/p>\n<p>In the midst of uncertainty surrounding federal OSHA\u2019s E-Recordkeeping Rule, several State Plans delayed adopting state versions, even after OSHA made it clear that state plans needed to act soon.\u00a0 While the majority of State Plans acted promptly to promulgate their own version of the E-Recordkeeping rule by the end of 2017, eight State Plans had not yet adopted the rule, including:<\/p>\n<ul>\n<li>California (Cal\/OSHA);<\/li>\n<li>Washington (WA DLI, WISHA, or DOSH);<\/li>\n<li>Maryland (MOSH);<\/li>\n<li>Minnesota (MNOSHA);<\/li>\n<li>South Carolina (SC OSHA);<\/li>\n<li>Utah (UOSH);<\/li>\n<li>Wyoming (Wy OSHA); and<\/li>\n<li>Vermont (VOSHA)<\/li>\n<\/ul>\n<p>Give the substantial number of State Plans that failed to comply with the Rule\u2019s order, federal OSHA attempted to force covered employers in these State Plans to submit 300A data despite not being subject to the rule or federal OSHA\u2019s jurisdiction.\u00a0 Specifically, on April 30, 2018, federal OSHA issued <!--more-->a\u00a0<span id=\"more-1722\"><\/span>press release announcing that\u00a0<em>employers<\/em>\u00a0in all State Plan States (not the State agencies themselves) must implement OSHA\u2019s E-Recordkeeping Rule. While employers were not required to submit 300A data and faced no enforcement risk for not doing so, federal OSHA\u2019s demand did resonate with delinquent State Plan administrators.<\/p>\n<p>Shortly after federal OSHA\u2019s April 30, 2018 press release, some of the delinquent states quickly moved to adopt the E-Recordkeeping Rule, including Minnesota, South Carolina, and Utah.\u00a0 South Carolina, even implemented a catch-up provision because the rule was finalized so close to federal OSHA\u2019s July 1, 2018 submission deadline \u2013 instead requiring employers submit 2017 300A data by November 25, 2018.\u00a0 Utah, on the other hand, passed on submission of 2017 300A data and simply required employers to comply with the upcoming March 1, 2019 deadline to submit 2018 300A data.<\/p>\n<p>Heading into 2019, however, there are still three State Plans that have declined to adopt the Rule \u2013 Maryland, Washington, and Wyoming. Therefore, unless one of these State Plans adopts the rule prior to the March 2, 2019 deadline to submit FY2018 300A data, covered establishments in those states are still not required to submit 300A data.<\/p>\n<p><strong>California: Dec. 31, 2018 Deadline to Submit 2017 300A Data Approaching<\/strong><\/p>\n<p>California did finally adopt an E-Recordkeeping Rule of its own, tracking the federal OSHA E-Recordkeeping Rule.\u00a0 On September 19, 2018,\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201720180AB2334\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1724 jetpack-lazy-image jetpack-lazy-image--handled\" src=\"https:\/\/i1.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2018\/12\/AB-2334.png?resize=446%2C299&amp;ssl=1\" alt=\"AB 2334\" width=\"446\" height=\"299\" \/><\/a>California Governor Jerry Brown signed\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201720180AB2334\" target=\"_blank\" rel=\"noopener\">California Assembly Bill 2334<\/a>\u00a0(\u201cAB 2334\u201d) largely in response to fed OSHA\u2019s recent\u00a0<a href=\"https:\/\/oshadefensereport.com\/2018\/08\/06\/osha-proposes-changes-to-its-controversial-e-recordkeeping-rule-industry-comments-are-needed\/\" target=\"_blank\" rel=\"noopener\">proposal to eliminate the requirement for large employers to submit 300 Log and 301 Incident Report level data<\/a>.<\/p>\n<p>Then, approximately one month later on October 18, 2018, Cal\/OSHA published an\u00a0<a href=\"https:\/\/www.dir.ca.gov\/dosh\/doshreg\/Recording-and-Reporting\/\" target=\"_blank\" rel=\"noopener\">emergency proposed regulation<\/a>\u00a0intended to temporarily adopt and implement the federal OSHA E-Recordkeeping Rule\u2019s data submission requirements.\u00a0 The Cal\/OSHA emergency regulations were approved by the California Office of Administrative Law and officially went into effect on November 1, 2018.<\/p>\n<p>The regulations amend Title 8 of the California Code of Regulations sections 14300.35 and 14300.41.\u00a0 However, since the California regulations were approved as emergency regulations, Cal\/OSHA will now proceed with the formal rulemaking process.<\/p>\n<p><em>Who must submit injury data?<\/em><\/p>\n<p>Covered establishments are required to submit 300A data through federal OSHA\u2019s ITA portal by the deadlines specified in the emergency regulation.\u00a0 The following workplaces are covered by the rule:<\/p>\n<ol>\n<li>Establishments with 250 or more employees who are subject to Cal\/OSHA recordkeeping requirements, unless specifically exempted by section 14300.2 of Title 8 of the California Code of Regulations<\/li>\n<li>Establishments with 20 to 249 employees in designated industries listed in\u00a0<a href=\"https:\/\/www.dir.ca.gov\/T8\/14300_48_AppendixH.html\" target=\"_blank\" rel=\"noopener\">Appendix H<\/a>.<\/li>\n<li>Establishments notified by Cal\/OSHA to submit injury data.<\/li>\n<\/ol>\n<p><em>When Must Covered Establishments Submit 300A Data?\u00a0<\/em><\/p>\n<p>The first deadline under Cal\/OSHA\u2019s emergency regulation is approaching soon, and covered establishments should take immediate steps to ensure they comply with the rule\u2019s requirements.\u00a0<em><a href=\"https:\/\/www.dir.ca.gov\/dosh\/doshreg\/Recording-and-Reporting\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1725 jetpack-lazy-image jetpack-lazy-image--handled\" src=\"https:\/\/i2.wp.com\/oshadefensereport.com\/wp-content\/uploads\/2018\/12\/EPR.png?resize=402%2C387&amp;ssl=1\" alt=\"EPR\" width=\"402\" height=\"387\" \/><\/a><\/em>Similar to South Carolina, California imposed a \u201ccatch-up\u201d provision to collect FY2017 300A data even though the rule was adopted after federal OSHA\u2019s deadline for 2017 data.\u00a0 Specifically,\u00a0<strong>covered establishments in California must submit FY2017 300A data by December 31, 2018<\/strong>.\u00a0 Covered establishments also have a short turnaround time to submit FY2018 300A by March 2, 2019.<\/p>\n<p><em>Next Steps for Employers<\/em><\/p>\n<p>Covered establishments should follow the instructions set forth on federal OSHA\u2019s Injury Tracking Application website to set up an account and account.\u00a0 Covered establishments should promptly review their 2017 300A data to ensure that it is accurate and ensure that a designated company representative is familiar with the ITA portal and prepared to submit the data by the initial December 31<sup>st<\/sup>\u00a0deadline.<\/p>\n<p>Employers should also stay tuned for further rulemaking to determine if Cal\/OSHA amends the current rule in the near future.\u00a0 AB 2334 requires Cal\/OSHA to \u201cmonitor\u201d rulemaking at the federal level and, if Cal\/OSHA determines that fed OSHA has \u201celiminated or substantially diminished\u201d the electronic recordkeeping rule, the California agency is required to convene an advisory committee within 120 days to \u201cevaluate how to implement the changes necessary to protect the goals\u201d of the proposed federal rule as issued in May 2016 under the Obama Administration.\u00a0 Thus, Cal\/OSHA did not rule out the possibility of imposing its own requirements \u2013 perhaps more stringent than those required by federal OSHA.<\/p>\n<p><strong>Cal\/OSHA Resurrects Obama-era Recordkeeping Statute of Limitations Rule<\/strong><\/p>\n<p>In other injury and illness recordkeeping news, AB 2334 goes even one step further by resurrecting a former controversial Obama-era safety and health rules.\u00a0 Notably, the Bill includes a provision that impacts the statute of limitations for issuing recordkeeping citations.\u00a0 Despite the D.C. Circuit\u2019s decision in\u00a0<a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/018A542863EAA754852579D8004EAFF4\/$file\/11-1106-1367462.pdf\" target=\"_blank\" rel=\"noopener\">AKM LLC dba Volks Constructors v. Secretary of Labor, 675 F.3d 752 (D.C. Cir. 2012)<\/a>\u00a0and the Cal\/OSHA Appeals Board decision in\u00a0<a href=\"https:\/\/www.dir.ca.gov\/oshab\/DECISIONS\/Key-Energy.(15-0255-0256).pdf\" target=\"_blank\" rel=\"noopener\">Key Energy Services\u00a0(DAR-15-0255-0256)<\/a>, which held that Cal\/OSHA cannot cite employers for failing to record injuries and illness if the violation took place more than six months before the citation was issued, AB 2334 seeks to establish recordkeeping violations as continuing violations, so as to expand the statute of limitations for such violations for the entire five-year period the record must be kept:<\/p>\n<blockquote><p>A citation or notice shall not be issued by the division more than six months after the occurrence of the violation. For purposes of issuing a citation or notice for a violation of subdivision (b) or (c) of Section 6410, including any implementing related regulations,\u00a0<em><strong>an \u201coccurrence\u201d continues until it is corrected, or the division discovers the violation, or the duty to comply with the violated requirement ceases to exist.\u00a0<\/strong><\/em>Nothing in this paragraph is intended to alter the meaning of the term \u201coccurrence\u201d for violations of health and safety standards other than the recordkeeping requirements set forth in subdivision (b) or (c) of Section 6410, including any implementing related regulations.<\/p><\/blockquote>\n<p>This is a major shift back to the Obama Administration\u2019s midnight \u201c<a href=\"https:\/\/www.federalregister.gov\/documents\/2016\/12\/19\/2016-30410\/clarification-of-employers-continuing-obligation-to-make-and-maintain-an-accurate-record-of-each\" target=\"_blank\" rel=\"noopener\">Volks Rule<\/a>,\u201d where fed OSHA adopted a five-year statute of limitations for recordkeeping violations during the final days of the Obama Administration.\u00a0 The federal rule was\u00a0<a href=\"https:\/\/oshadefensereport.com\/2017\/02\/24\/oshas-midnight-attempt-to-overrule-federal-courts-decision-is-ripe-for-rescission-wlf-article\/\" target=\"_blank\" rel=\"noopener\">repealed quickly by the Trump Administration<\/a>\u00a0when the Republican Congress and new President Trump signed a resolution to revoke the rule under the Congressional Review Act.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By\u00a0Andrew Sommer,\u00a0Megan Shaked, and\u00a0Dan Deacon As we have reviewed previously on the\u00a0OSHA Defense Report, federal OSHA\u2019s Rule to \u201cImprove Tracking of Workplace Injuries and Illnesses\u201d (aka the E-Recordkeeping Rule) requires small employers that operate in certain \u201chigh&hellip;<\/p>\n","protected":false},"author":3,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":"","_links_to":"","_links_to_target":""},"categories":[442],"tags":[36,499],"class_list":["post-295","post","type-post","status-publish","format-standard","hentry","category-cal-osha-inspections-citations-enforcement","tag-injury-illness-recordkeeping-reporting-300-300a-301","tag-state-osh-programs"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Delinquent State OSH Agencies Adopt E-Recordkeeping; Calif.
