Gelb<\/em><\/a><\/p>\n<p>As the dust settles on the 2024 Election Cycle and the pundits continue analyzing and dissecting the results, the OSHA\/MSHA Team at Conn Maciel Carey draws from decades of experience representing employers during Republican and Democratic administrations to forecast how the workplace safety and health landscape may change with respect to enforcement, compliance assistance, and rulemaking under a second Trump Administration.<\/p>\n<p><strong><em><u>Enforcement Resources and Priorities<\/u><\/em><\/strong><\/p>\n<p>At the federal level, history can provide insight into the likely priorities of a second Trump term.\u00a0 As loyal readers of this blog know, OSHA operated without a confirmed Assistant Secretary for the entirety of the first Trump Administration.\u00a0 While agencies lacking Senate-confirmed leaders can feel adrift and directionless, with confusion about roles, responsibilities, and priorities, it was essentially business as usual at OSHA under Trump\u2014at least until COVID-19 hit\u2014with other agencies facing more focused efforts to deregulate.\u00a0 While it is not yet clear how quickly the second Trump Administration will turn its sights to OSHA, we\u2019re unlikely to see a push to increase OSHA\u2019s budget or even to backfill enforcement personnel who leave the agency.\u00a0 OSHA had the fewest compliance officers in its history during the Trump Administration, and despite efforts by President Biden to increase staffing levels, the number of enforcement personnel is sure to ebb again.\u00a0 Fewer compliance officers will lead to decreased enforcement activity, as well as overwhelming workloads for remaining employees, and such a combination often results in reduced morale.<\/p>\n<p>OSHA under Trump 2.0 is likely to adopt more employer-friendly policies than President Biden\u2019s current administration and could:<!--more--><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><a href=\"https:\/\/www.osha.gov\/cooperativeprograms\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" title=\"Blog 1 300x241\" class=\" wp-image-9013 alignright\" src=\"https:\/\/oshadefensereport.com\/wp-content\/uploads\/2024\/11\/blog-1-300x241.png\" alt=\"Blog 1 300x241\" width=\"377\" height=\"303\" \/><\/a>Prioritize compliance assistance efforts, including increasing the avenues to <a href=\"https:\/\/www.osha.gov\/cooperativeprograms\" target=\"_blank\" rel=\"noopener\">foster cooperation<\/a> between OSHA and employers by expanding its Alliance, Strategic Partnership, Voluntary Protection, Challenge, and On-Site Consultation Programs.<\/li>\n<li>Scale back or even stop using press releases and safety and health data to publicly shame employers, e.g., through the agency\u2019s severe injury dashboard. Even if OSHA continues issuing press releases, history teaches that employers can expect far fewer of them and that those which are issued will have a decidedly different, less sensational tone.<\/li>\n<li>Roll back enforcement policies and practices adopted by the Biden Administration, such as OSHA\u2019s expanded application of its instance-by-instance citation policy; lowered thresholds for inclusion in the Severe Violator Enforcement Program; and more aggressive use of, e.g., egregious, willful, and repeat citations. In other words, we can assume that OSHA will no longer be exploring creative ways to use all of the tools in its toolbox\u2014some tools will be dulled and others will simply be put back on the shelf.<\/li>\n<li>Reduce the number of emphasis programs by declining to renew, or even withdrawing, certain NEPs, REPs, and\/or LEPs\u2014changes that tend to occur during Republican administrations, resulting in a shift from proactive enforcement to more reactive responses addressing major incidents and credible complaints.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>However, the \u201claw-and-order\u201d approach touted by Conservatives could lead to additional citations targeting bad actors, specific companies, or emphasis industries that draw the new administration\u2019s attention.\u00a0 Consequently, these entities may continue to experience aggressive enforcement under the Trump regime.<\/p>\n<p><strong><em><u>Regulatory Impact<\/u><\/em><\/strong><\/p>\n<p>During his first administration, President Trump implemented a policy that for every new rule promulgated, two existing regulations should be withdrawn.\u00a0 He also required a review of agency guidance, directing departments to pull public materials that arguably expanded obligations, rather than simply restating existing legal obligations. \u00a0With Congress likely on his side and the judiciary demonstrating an eagerness to limit agencies\u2019 rulemaking powers, we could see similar \u2013 or more stringent \u2013 practices reanimated.\u00a0 The Congressional Review Act and recent Supreme Court decisions <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-451_7m58.pdf\" target=\"_blank\" rel=\"noopener\"><em>Loper Bright<\/em><\/a>, <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-859_1924.pdf\" target=\"_blank\" rel=\"noopener\"><em>Jarkesy<\/em><\/a>, and <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-1008_1b82.pdf\" target=\"_blank\" rel=\"noopener\"><em>Corner Post<\/em><\/a> will bolster efforts to rein in agency action, and the Trump Administration will push continued deregulation.<\/p>\n<p>This environment leaves the fates of recent and pending OSHA rulemakings in question.<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Many expect President Trump to drop the government\u2019s defense of OSHA\u2019s \u201c<a href=\"https:\/\/oshadefensereport.com\/2024\/06\/07\/industry-groups-and-congressional-leaders-attack-oshas-new-worker-walkaround-inspection-rule\/\" target=\"_blank\" rel=\"noopener\">Worker Walkaround Representative Designation Process<\/a>\u201d rule, which allows certain third parties to participate in OSHA worksite inspections and is currently <a href=\"https:\/\/www.uschamber.com\/lawsuits\/u-s-chamber-sues-the-occupational-safety-and-health-administration-over-walkaround-rule\" target=\"_blank\" rel=\"noopener\">under contest<\/a> in the Western District of Texas.\u00a0 We pause to consider Candidate Trump\u2019s courting of the union vote, as labor organizations favor the expanded participation allowed under the new walkaround rule, but despite promises from the campaign trail, the winds of change portend the rule\u2019s demise.<\/li>\n<li>OSHA\u2019s proposed \u201c<a href=\"https:\/\/oshadefensereport.com\/2024\/08\/30\/fed-oshas-heat-illness-prevention-proposed-rule-officially-published-in-the-federal-register\/\" target=\"_blank\" rel=\"noopener\">Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings<\/a>\u201d rule\u2019s comment period remains open until December 30, 2024, but how a new OSHA team considers comments and whether it decides to pursue further action after January 20, 2025 is open for debate.\u00a0 States with Republican leadership have not been keen to implement rules combatting heat illness and injury, see <a href=\"https:\/\/laws.flrules.org\/2024\/80\" target=\"_blank\" rel=\"noopener\">Florida<\/a>, and that approach could trickle up to the federal level in President Trump\u2019s OSHA.<\/li>\n<li>OSHA scheduled a <a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/07\/23\/2024-16126\/emergency-response-standard\" target=\"_blank\" rel=\"noopener\">public hearing<\/a>, set to begin November 12, 2024, on its proposed \u201c<a href=\"https:\/\/oshadefensereport.com\/2024\/05\/24\/update-on-oshas-emergency-response-rulemaking\/\" target=\"_blank\" rel=\"noopener\">Emergency Response Standard<\/a>.\u201d We expect the current administration to keep this rulemaking process moving forward.\u00a0 But under Trump\u2019s OSHA, the rule could be deprioritized, with opponents having characterized OSHA\u2019s proposal as overburdensome and unclear.<\/li>\n<li>A rule that exemplifies the regulatory ping pong OSHA has experienced through recent administrative transitions is the agency\u2019s regulation to \u201c<a href=\"https:\/\/oshadefensereport.com\/2023\/07\/18\/white-house-clears-the-final-amended-electronic-recordkeeping-rule\/\" target=\"_blank\" rel=\"noopener\">Improve Tracking of Workplace Injuries and Illnesses<\/a>.\u201d\u00a0 This rule, requiring designated employers to electronically submit injury and illness data, launched under the Obama Administration, was dialed back under President Trump\u2019s first term, and then found new life under President Biden.\u00a0 Its history describes but one example of how each new administration\u2019s reversals of preceding policy create confusion for employers, employees, and even government personnel trying to execute presidential directives.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong><em>State Activities<\/em><\/strong><\/p>\n<p><a href=\"https:\/\/www.osha.gov\/stateplans\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" title=\"Blog 2 300x178\" class=\" wp-image-9018 alignright\" src=\"https:\/\/oshadefensereport.com\/wp-content\/uploads\/2024\/11\/Blog-2-300x178.png\" alt=\"Blog 2 300x178\" width=\"418\" height=\"248\" \/><\/a>So, what does this all mean?\u00a0 Forget about compliance because OSHA is about to disappear?\u00a0 Absolutely, not.\u00a0 Enforcement will continue \u2013 albeit with shifted priorities \u2013 at the federal level.\u00a0 In addition, the importance of state plan enforcement will increase.<\/p>\n<p>The Occupational Safety and Health Act, at <a href=\"https:\/\/www.osha.gov\/laws-regs\/oshact\/section_18\" target=\"_blank\" rel=\"noopener\">section 18<\/a>, allows states to operate their own federally-approved OSHA programs, and <a href=\"https:\/\/www.osha.gov\/stateplans\" target=\"_blank\" rel=\"noopener\">according to OSHA<\/a>, \u201c[t]here are currently 22 State Plans covering both private sector and state and local government workers, and seven State Plans covering only state and local government workers.\u201d\u00a0 Private employers in state plan states are subject to state workplace safety and health requirements, which can be stricter than federal obligations.\u00a0 State plan programs may look to fill any enforcement gap under the second Trump Administration by ramping up their aggressiveness to ensure compliance with local rules.<\/p>\n<p>For example, we can expect California\u2019s Division of Occupational Safety and Health \u2013 lovingly known as Cal\/OSHA \u2013 to push the bounds of worker protection.\u00a0 California Governor Gavin Newsom appears set to establish himself as a foil to President Trump, as the governor <a href=\"https:\/\/apnews.com\/article\/california-donald-trump-gavin-newsom-special-session-32511d5887409d68d692e094ed50a272\" target=\"_blank\" rel=\"noopener\">has already called for<\/a> a special December session of the California legislature designed to \u201cTrump-proof\u201d the State.\u00a0 But California won\u2019t be alone, as jurisdictions like Washington, Oregon, and Michigan also will seek to lead in workplace safety and health enforcement.<\/p>\n<p>Legislatures in these states, and elsewhere, could increase their workplace safety and health activities as well.\u00a0 We\u2019ve already seen such movement in California with its workplace violence prevention requirements, and even in jurisdictions where federal OSHA regulates private employers, such as New York or Illinois, like-minded legislatures could up their safety and health games.<\/p>\n<p>We\u2019ll continue to update this space with thoughts on the upcoming presidential transition, so stay tuned.\u00a0 In the
