{"id":1713,"date":"2022-11-04T17:11:35","date_gmt":"2022-11-04T21:11:35","guid":{"rendered":"https:\/\/caloshadefensereport.com\/?p=1713"},"modified":"2026-03-20T09:24:52","modified_gmt":"2026-03-20T16:24:52","slug":"california-employers-covid-19-prevention-coalition-submits-second-round-of-comments-on-cal-oshas-non-emergency-covid-rule","status":"publish","type":"post","link":"https:\/\/www.connmaciel.com\/calosha-defense-report\/california-employers-covid-19-prevention-coalition-submits-second-round-of-comments-on-cal-oshas-non-emergency-covid-rule\/","title":{"rendered":"<strong>California Employers COVID-19 Prevention Coalition Submits Second Round of Comments on Cal\/OSHA\u2019s Non-Emergency COVID Rule<\/strong>"},"content":{"rendered":"<p><span style=\"font-size: revert;\">The rulemaking process continues for Cal\/OSHA\u2019s Proposed Non-Emergency COVID-19 rule, with the second comment period for the modifications closing.<\/span><\/p>\n<p><a href=\"https:\/\/mcusercontent.com\/1f7d734e8deab2d2adeeace34\/files\/a75ea0b9-e65c-cafc-7eae-fa663955be9e\/Conn_Maciel_Carey_Comments_to_the_Proposed_Permanent_Cal_OSHA_COVID_19_Rule_Submitted_10_31_22__1.pdf\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" title=\"Capture 300x282\" class=\" wp-image-1716 alignright\" src=\"http:\/\/caloshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/4\/2022\/11\/Capture-300x282.png\" alt=\"Capture 300x282\" width=\"450\" height=\"423\" srcset=\"https:\/\/www.connmaciel.com\/calosha-defense-report\/wp-content\/uploads\/sites\/4\/2022\/11\/Capture-300x282.png 300w, https:\/\/www.connmaciel.com\/calosha-defense-report\/wp-content\/uploads\/sites\/4\/2022\/11\/Capture.png 574w\" sizes=\"(max-width: 450px) 100vw, 450px\" \/><\/a>Conn Maciel Carey again submitted comments on behalf of the California Employers COVID-19 Prevention Coalition.\u00a0 The Coalition, comprised employers and trade groups, \u00a0has been active in the rulemaking for the Cal\/OSHA COVID-19 Prevention Emergency Temporary Standard (ETS) and the Proposed Non-Emergency\/Permanent COVID-19 Prevention Standard (Proposed Non-emergency Rule).<\/p>\n<p>A copy of the Coalition\u2019s October 31 comments are available <a href=\"https:\/\/mcusercontent.com\/1f7d734e8deab2d2adeeace34\/files\/a75ea0b9-e65c-cafc-7eae-fa663955be9e\/Conn_Maciel_Carey_Comments_to_the_Proposed_Permanent_Cal_OSHA_COVID_19_Rule_Submitted_10_31_22__1.pdf\" target=\"_blank\" rel=\"noopener\"><strong>here<\/strong><\/a>.\u00a0 To summarize, our comments primarily addressed three concerns raised by the rule modifications:<\/p>\n<p><strong>Definition of Close Contact<\/strong><\/p>\n<p>On October 13, 2022, the California Department of Public Health updated its definition of \u201cclose contact\u201d to<!--more--> distinguish between indoor spaces of 400,000 or fewer cubic feet per floor and those larger indoor spaces greater than 400,000 cubic feet per floor.\u00a0 For the larger workplaces, CDPH returned to the Centers for Disease Control and Prevention\u2019s measurable \u201cclose contact\u201d standard, incorporating the 6-feet benchmark consistently relied upon by OSHA, public health agencies and employers across the country for over two years.\u00a0 However, for smaller indoor spaces, the CDPH definition continues to rely on the concept of \u201csharing the same <strong><em>indoor airspace<\/em><\/strong>.\u201d The comments advocated that a similar definition should apply to all indoor workplaces and not just larger spaces, as called for in the revised CDPH definition.<\/p>\n<p>We requested that if the Board is inclined to retain the more expansive definition of \u201cclose contact\u201d for smaller indoor spaces. that the rule add clarifying language recognizing the importance of proximity to the COVID-19 case, as well as the direction of airflow, the facility\u2019s configuration and engineering controls, as considerations in determining close contacts.<\/p>\n<p><strong>Exclusion Pay<\/strong><\/p>\n<p>During the October Standards Board meeting, there was heated discussion over the topic of exclusion pay. The Proposed Non-Emergency Rule has omitted exclusion pay, which has been part of the ETS for employees who quarantine or isolate due to a COVID-19 workplace exposure. In our comments, we have advocated against including exclusion pay in the Proposed Non-Emergency Rule given the evolving COVID-19 conditions, including the availability of vaccinations, milder symptoms and significantly lower rates of COVID-19 related hospitalizations and fatalities, and the community-spread characteristic of COVID-19 infection. In announcing that California\u2019s COVID-19 State of Emergency will end on February 28, 2023, Governor Newsom cited these very circumstances to support that decision.<\/p>\n<p>In response to questions and doubts conveyed by various members of the Standards Board at its last meeting, our comments provide an overview of the numerous California laws providing job protections and benefits for reasons related to COVID-19, including workers\u2019 compensation paid benefits, paid disability and family leave benefits, paid sick leave, and other protections under the California Fair Employment and Housing Act, California Family Rights Act and California Labor Code.<\/p>\n<p>The comments also offered an explanation for why the exclusion pay provision under the Aerosol Transmissible Diseases Standard is unique and not appropriate for expansion to all employers across all industries.<\/p>\n<p><strong>Sunset Clause<\/strong><\/p>\n<p>Finally, we reiterated our recommendation that the Proposed Non-Emergency Rule include alternative bases for terminating the Rule.
