{"id":1688,"date":"2022-10-18T13:23:52","date_gmt":"2022-10-18T17:23:52","guid":{"rendered":"https:\/\/caloshadefensereport.com\/?p=1688"},"modified":"2026-03-20T09:24:51","modified_gmt":"2026-03-20T16:24:51","slug":"governor-newsom-to-end-covid-19-state-of-emergency-while-standards-board-marches-on","status":"publish","type":"post","link":"https:\/\/www.connmaciel.com\/calosha-defense-report\/governor-newsom-to-end-covid-19-state-of-emergency-while-standards-board-marches-on\/","title":{"rendered":"Governor Newsom to End COVID-19 State of Emergency, While Standards Board Marches On"},"content":{"rendered":"<p>In major news yesterday, Governor Newsom <a href=\"https:\/\/www.gov.ca.gov\/2022\/10\/17\/governor-newsom-to-end-the-covid-19-state-of-emergency\/\">announced<\/a> that California\u2019s COVID-19 State of Emergency will end on<strong><em> February 28, 2023.\u00a0 <\/em><\/strong>See the following excerpts from the governor&#8217;s press release:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.gov.ca.gov\/2022\/10\/17\/governor-newsom-to-end-the-covid-19-state-of-emergency\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" title=\"Capture 1\" class=\" wp-image-1691 alignright\" src=\"http:\/\/caloshadefensereport.connmaciel.stagingarea.org\/wp-content\/uploads\/sites\/4\/2022\/10\/Capture-1.png\" alt=\"Capture\" width=\"411\" height=\"406\" srcset=\"https:\/\/www.connmaciel.com\/calosha-defense-report\/wp-content\/uploads\/sites\/4\/2022\/10\/Capture-1.png 536w, https:\/\/www.connmaciel.com\/calosha-defense-report\/wp-content\/uploads\/sites\/4\/2022\/10\/Capture-1-300x297.png 300w\" sizes=\"(max-width: 411px) 100vw, 411px\" \/><\/a>\u201cWith hospitalizations and deaths dramatically reduced due to the state\u2019s vaccination and public health efforts, <strong><em>California has the tools needed to continue fighting COVID-19 when the State of Emergency terminates at the end of February, including vaccines and boosters, testing, treatments and other mitigation measures like masking and indoor ventilation.<\/em><\/strong> As the State of Emergency is phased out, the SMARTER Plan continues to guide California\u2019s strategy to best protect people from COVID-19.\u201d<\/li>\n<li>\u201cThroughout the pandemic, we\u2019ve been guided by the science and data \u2013 moving quickly and strategically to save lives. <strong><em>The State of Emergency was an effective and necessary tool<\/em><\/strong> that we utilized to protect our state, and we wouldn\u2019t have gotten to this point without it,\u201d said Governor Newsom. <strong><em>\u201cWith the operational preparedness that we\u2019ve built up and the measures that we\u2019ll continue to employ moving forward, California is ready to phase out this tool.\u201d<\/em><\/strong><\/li>\n<li>\u201cTo maintain California\u2019s COVID-19 laboratory testing and therapeutics treatment capacity, the Newsom Administration will be <strong><em>seeking two statutory changes immediately upon the Legislature\u2019s return: 1) The continued ability of nurses to dispense COVID-19 therapeutics; and 2) The continued ability of laboratory workers to solely process COVID-19 tests.\u201d<\/em><\/strong><\/li>\n<\/ul>\n<p>In contrast to Governor Newsom&#8217;s announcement, however, the Cal\/OSHA Standards Board continues to advance a\u00a0 proposed non-emergency COVID-19 rule, with a two-year fixed term extending well beyond the end of the State of Emergency. Just last Friday, the Standards Board issued a revised draft of the non-emergency rule providing a 15-day notice period for comments. The revised non-emergency rule provides the following substantive changes: <!--more--><\/p>\n<ul>\n<li>The \u201cclose contact\u201d definition is updated to incorporate the CDPH\u2019s new definition announced last Thursday in a public health order. Specifically, \u201cclose contact\u201d means the following (unless otherwise defined by regulation or order of CDPH, in which case the CDPH definition applies):\n<ul>\n<li>In indoor spaces of <strong><em>400,000 or fewer cubic feet per floor<\/em><\/strong>, a close contact is defined under the existing definition requiring the close contact <strong><em>\u201cshare the same indoor airspace as a COVID-19 case<\/em><\/strong>\u2026.\u201d<\/li>\n<li>In indoor spaces of <strong><em>greater than 400,000 cubic feet per floor<\/em><\/strong>, a close contact is defined as being within <strong><em>six feet of the COVID-19 case<\/em><\/strong> for a cumulative total of 15 minutes or more over a 24-hour period\u2026.\u201d<\/li>\n<li>The definition also incorporates the provision from the public health order that<em> \u201c[o]ffices, suites, rooms, waiting areas, break or eating areas, bathrooms or other spaces that <strong style=\"font-size: 1rem; color: initial;\">are separated by floor-to-ceiling walls shall be considered distinct indoor spaces.\u201d<\/strong><\/em><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>\u201cExposed group\u201d definition\n<ul>\n<li>For the exception concerning individuals who momentarily pass through a work area, the text has eliminated the requirement that \u201ceveryone [be] wearing face coverings.\u201d The revised text reads:\u00a0 <em>\u201cFor the purpose of determining the exposed group, a place where persons momentarily pass through without congregating, is not a work location, working area, or a common area at work.\u201d<\/em><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>\u201cReturned case\u201d definition\n<ul>\n<li>The revised draft changes the time period (from 90 to 30 days) in which individuals who previously had COVID-19 are considered \u201creturned cases.\u201d\u00a0 The text now reads:\u00a0 \u201cA person shall only be considered a returned case for <strong><em>30 days after the initial onset of COVID-19 symptoms<\/em><\/strong> or, if the person never developed COVID-19 symptoms, <strong><em>for 30 days after the first positive test.<\/em><\/strong> If a period of other than 30 days is required by a CDPH regulation or order, that period shall apply.\u201d<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>\u00a0Ventilation\n<ul>\n<li>Eliminates language requiring employers to \u201cevaluate\u201d whether the current ventilation is adequate to prevent transmission. Instead, the revised language uses seemingly obligatory language stating that \u201cEmployers shall develop, implement, and maintain effective methods to prevent transmission of COVID-19 including one or more of the following actions to improve ventilation [maximize supply of outside air to the extent feasible, or provide MERV-13 or greater ventilations system or HEPA filtration units].\u201d<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>Reporting and recordkeeping\n<ul>\n<li>Eliminates language requiring employers to report COVID-19 cases and outbreaks to the local health department.<\/li>\n<li>Removes language requiring employers to keep a record of persons who had a close contact, including name, contact information and date of notice of close contact.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>Outbreaks\n<ul>\n<li>Slightly increases the threshold for ending an outbreak.
